Civil Service - can I just resign whilst suspended?

I was suspended yesterday for Gross Misconduct. They won't tell me whole story but it's an external complaint.

Checked CS employment guidelines and the process would continue if I resigned. "If the outcome is dismissal ..... this would replace resignation as the reason for contract ending PROVIDED THE NOTICE PERIOD REQUIRED OF THF EMPLOYER IS SHORTER THAN EMPLOYEES NOTICE ". So if they dismiss me with no notice within a month then my reference would show dismissal.

Can't think straight - would very much appreciate help. Don't have a union rep or legal cover under home insurance.

Terrified to tell my OH - he just thinks I'm WFH.

Do you have an employee helpline? Ours (public sector) can be helpful so worth calling them to see, although I’ve heard mixed reports. As others say it’s very early in the process, but you do need support from friends and /or family.
I was going to suggest this. I'm a civil servant - haven't used the Employee Assistance Programme myself but have heard mostly good things from other people.

Good luck with your call op. Can you try to record it so you can listen to it again? Chances are you won't take it all in at the time.

I’d ascertain the nature of the allegation (perhaps you have by now, this thread is a few days old) and then call ACAS.

This is a nightmare but try and keep your head.

Photocopy all documentation that is relevant to the issue for your solicitor/union rep to see.

Make no comment to anyone from work until you have taken advice.

Have you had any more info from them OP? Its a disgrace that they wont tell you what they are supposedly investigating.

If you genuinely have zero idea of why you have been suspended then talk to HR, they should have informed you before you were suspended. As you aren't telling your DH I suspect you know its likely you'll be dismissed and what you have done- yes you can resign but the process continues as it will show up certainly on a reference for another civil service job, and possibly for external ones (depending what they request). Confused why you aren't challenging this if you don't even know what it's for, I'd start by being honest with yourself, your husband and with work.

Am I right in thinking that your previous employer has made a malicious allegation against you? How exactly is that gross misconduct?!

This sounds ridiculous. I hope it's all resolved soon.

Op sorry to hear this esp if you feel somethings wrong. FYI I've dealt with three gross misconduct and only one got fired in the end. The ones thst got off included turning up to work drunk on multiple occasions and the other one was someone who posted a photo of the office on Instagram including other people's computer screens.

I have dealt with one firing. This person used customer information from our records to harass a woman for a date.

The allegation might be malicious, so be investigated and then dropped

If it’s an ex-employer who is now a client I wonder if it’s a conflict of interest thing. Did you have any role in helping this person/organisation become a client for your Department?
