Overpaid holiday

user7866655 · 19/03/2022 09:14

My holiday allowance at work is shown on the machine where we clock in and out, I don't keep a record of what holidays I have taken I just go by the machine.
Today my manager told me that the machine is wrong and I have been overpaid holidays by 30 hours and is telling me I have to pay the money back. Holiday year is ending at the end of this month.
I don't know what to do I went by the machine like I always do, I can't afford to have money deducted from my wages.

Firstly ask them to show you the records to confirm this

Secondly ask if it can be laid back over a number of months rather than as a one off

Thirdly in future keep your own track too

Speak to ACAS or your union. You have acted in good faith and it’s their mistake. At the very least you should be allowed to repay in instalments .

I would request that you pay back at the rate you accrue them. Which is just under 2 full days a month FTE. So for most people that would be roughly over 2 paypackets. If even over multiple pay packets is too much, then you need to explain that paying back will cause significant financial hardship, so request over the time period you could manage the best.

I'd also ask for a record to show the discrepancy and ask for an explanation as to how their system failed. As this is their failure and issue.

Definitely get evidence of how you have been overpaid.

Start keeping your own records of when you take leave.

Ask if you can repay by working extra hours rather than a deduction of salary. For example two hours a week over 15 weeks. If you have an hour for lunch consider taking 30 minutes etc.

Make sure everything is in writing so you have a paper trail of requests and answers.

30 hours is the bones of a full week
I think it's looks suspicious to be honest . Most people know exactly how much holiday they've used each year to date.

You will have to pay it back but offer small instalments .

They can't usually take it in one go.

Ask for everything to be put in writing and for them to tell you when the rrors happened.
