Holiday refused

My holiday year runs April - March and I have one days holiday left to take this year. I received a hospital appointment today for next Friday, the hospital is 3 hours away so will need a full day off. I asked my manager if I could take the day as holiday but she has refused as it is short notice. No one else is off on holiday that day.
Can she do this? I will have to attend the appointment so it will be unpaid and then I will lose my days holiday because the new financial year will start.

Its a bit rubbish of her, but yes she can refuse holiday. As long as she gives a reason why, and she has. Do you have any written rules on how much notice you have to give for holiday requests?

Ask for a written explination as to why annual leave has been refused for a hospital appointment you’ll now have to take unpaid leave for and lose the annual leave?

Why do you have to loose the leave? Your employer is required by law to ensure you are able to take your leave. I would not loose it. If they will not permit you to take it then request to carry it over.

They can refuse you paid leave - but cannot refuse you medical treatment so perhaps the combination if pushed will make them rethink?

They are only required legally to ensure that the legal minimum is taken (20 days + 8 bank holidays).

That said, they are clearly being cunts in this case.

Did you not anticipate losing the annual leave giving there is only 11 possible days left to take it?

Can you not carry any at all over to the next year?

Ultimately, work do not have to award annual leave when you want it.

Have you explained that you have a hospital appointment?

Is there a reason it's 3 hours away - is it a specialist hospital and for a disability? If so that may have some sway. They don't have to grant unpaid leave and it can be viewed as awol.

There is no general statutory right to time off, either paid or unpaid, to attend medical or dental appointments. Op may well have a contractual right to time off in these circumstances and, depending on the terms of the employment contract, this might be either paid or unpaid and a maximum duration for each appointment might be specified.

She can refuse it if your leave policy requires you to give a specified number of days - although in this case it would be unreasonable for her to refuse if it’s a hospital appointment next Friday (ie 10 days away) rather than this Friday. The problem though is that if everyone in the team saves one or two days to use in the last two weeks of the leave year then the team could be left very short staffed, so she’s right to discourage that.
What were her reasons for refusing your annual leave request?

Have you explained the application has only just come through, and if you take it unpaid your still not there, ask if there is any movement on the no, by email and copy in who she reports too. Send ver mean to me
