No witch-hunt please am asking on behalf of a friend. Friend was involved in a disciplinary at work and had sanctions put on record for 12months.one of the sanctions was redeployment to where they are now.trying to not be outing but it's nhs trust.friend is not happy where r but they wondered if they left the Trust and went to another Trust would the new Trust be told of the sanctions or is it best to stay where is for 12months and wait until sanctions are removed. Or if they left completely before the sanctions are lifted and then perhaps wanted to return in a year or so would the sanctions still be there as yr not completed. Any advice welcome

It's very likely new Trust would be told of sanctions & your friend didn't tell the Trust themselves that could make it even worse for them.

Yes I agree so probably best for them to maybe tolerate it for another 7months.do you think if they got another job away from nhs then if wanted to return say in 18months the sanctions would still be there as they wouldn't of done the time.

The sanctions will probably remain on their NHS record, yes. It depends what their role is and if they have a regulator (eg NMC, HMC, HCPC) whether they'd be reactivated on their return to the NHS.

Most employers will require a reference for a new job and will often ask questions about live warnings on file.

Don't forget that in roles like the NHS and education, they ask for references for 2-3 years, so it wouldn't just be a case of leaving for a few months and then returning. If the leave with an active warning on their file, the reference may well state that.

My recommendation would be for your friend to keep their head down, prove they are a good employee and leave once the warning expires.

Also, don't forget that people do move around in the NHS. Managers interviewing your friend for potential roles, may well have connections from her current Trust and people do talk. I've known managers to contact peers for off the record references about candidates.
