Part time work, BH query

I'll try to be brief, probably impossible knowing me.
I work part time but with hours on most days, including Mondays.
My holiday entitlement is 21 days and they then take bank holidays out of that entitlement. So I'm down to 77 hours holiday per year from 126 hours.
Fair enough but they are now expecting me to work on two bank of the bank holidays. What's more annoying is that it's only for two hours on each of those days so it not only cocks up the days royally but I can't even say the money would make it worthwhile.
My question is whether this is fair? I would be able to get overtime, which works out at £28 for the 2 hours as time and a half but am I wrong in thinking the fairer way would be to give me back the 6.5hr and 4 hours holiday time that I have lost for those two days?
What is the norm in this situation?

Can't you ask for the holiday hours instead of pay?

bobkate · 11/02/2022 09:52

Possibly...I suppose I wanted to see if anyone in the know could say if that was a reasonable request. It was my initial thought.

Yes you can request the BH hours back plus overtime but only for hours worked.

bobkate · 12/02/2022 14:10

Oh so it's pants whichever way Sad thank you for replying.

Your best option is to offer to work the whole day on the BH, get paid overtime and then have a whole days leave.

NoSquirrels · 12/02/2022 14:56

Have you checked your holiday entitlement on part time hours? You’re not getting shortchanged in the first place?

bobkate · 12/02/2022 18:21

Unfortunately I don't think I'm short changed, despite it feeling so. There are just lots of bank hols this year and as I work every day bar Thursday that's a lot of hours removed from my annual entitlement.
The other problem is that on bank hols they only open for 2 hours for emergencies so I can't even offer to work the full day.

Is this NHS OP? I left my part time nhs admin job a few years ago for this reason, the hours you're left with after they take BH off is not much at all. I have now taken a new job that is Thursday and Fridays!

Would you not just deduct the balance from your leave hours?

AlexaShutUp · 12/02/2022 18:31

I think you could (and should) ask that they adjust your holiday entitlement so that they only deduct the hours that you would have worked but didn't (ie your normal working hours for that day minus two). In addition to paying you at time and a half for the hours worked.

I don't think it's reasonable to expect that they will give you all of the holiday back though.

Ah, now this makes sense. So I should be doing 10.5 hours on those two days so you're saying it's not unreasonable to ask for 6.5 hours back. Whether or not I can bring myself too is another matter! But that would give me one more day off. Whoopdidoo Grin Thanks for the tips. And not NHS no, but similar.

Yes @bobkate, that's what I meant.

Thinking about it a bit more, though, it might depend on how they're paying you for it.

Are you normally paid a salary? Or do you get paid by the hour?

If they pay you extra for 6 hours (ie 4 x 1.5) on top of your normal salary, then they might argue that you still got paid for your normal leave entitlement in the salary payment. So you wouldn't be owed anything.

However, if they only pay you the extra to cover the higher rate (ie for 2 hours to cover the extra 0.5), then they will owe you four hours back from your leave entitlement.

Sorry, hope that makes sense. Struggling to articulate it clearly!

HunterHearstHelmsley · 12/02/2022 19:14

I think @AlexaShutUp means that it's not unreasonable to ask for the 2 hours worked back, as well as getting time and a half for the hours.

I'd be very surprised if they agree to that. I expect if you ask for the (2 hours per BH worked) leave back, you'll get that instead of the pay.

Thanks all.... to be honest I think I'll probably just suck it up and put it down to me not clarifying the situation before accepting the job. I suppose I just wanted to know if I was justified in feeling a bit miffed about the situation! I think I'm more miffed at myself for the lack of clarification on my side! Twit Hmm
