New job while on maternity

Hi,

I have just found Out that's I've been offered an new job as I'm currently on maternity and I should be returning back in April but where I currently work they can't offer me what I want and it a bit to travel while it new job is closer to home and they're flexible with me allowing me to work from home and in the office.

I'm worried on how to tell my currently employer that I have a new job and that I should be starting around March time especially with being on SMP. Was wondering if I could please have advise on how to tell my employer about my new job...

Just give the required notice of your resignation. You don't need to say its because you have a new job. Will you be on the unpaid part of maternity leave?

I'm on my 30th week of my maternity pay I've got 9 weeks left of it

If you start your new job before the end of your paid leave then your SMP will stop.

I thought that but wasn't sure if I had to pay anything back with it being the government SMP as my partner dad an Manager and he thought I didn't have to pay

Have you been on SMP the whole time? If you had enhanced pay you may need to pay this back if you don't return, check your contract.

If its only SMP then you don't owe anything. If you got enhanced pay you may have to pay the enhanced payment back

Looks like you're just getting SMP then so won't need to pay anything back. And you need to give 4 weeks notice to resign. You would still get SMP until you start in your new job

You may be entitled to receive Statutory Maternity Pay (SMP) SMP is payable for a maximum 39 weeks. Generally speaking, the first 6 weeks of SMP is paid at 90% of your average weekly earnings. The remaining maximum 33 weeks is paid at the standard rate, however, if 90% of your average weekly earnings is less than the standard rate, you will receive 90% of your average weekly earnings for the entire maternity pay period. The average weekly earnings are taken from the 8 weeks up to and including the ‘qualifying week’. Your qualifying week is 14th March 2021

The current standard rate of SMP is £151.20. However, the amount you receive may vary depending on the dates of your leave. Therefore, at this time, I cannot confirm your entitlement to SMP.

I must inform you that any entitlement to SMP may be affected if you work for another employer whilst you are receiving SMP. You must therefore inform us if this happens.

If you decide you do not wish to return to work after the birth of your baby you must give me 4 weeks written notice of your resignation in accordance with your contract of employment. Your decision will not affect your entitlement to SMP.

My maternity is supposed to finish at the end of April and this new job is to start Around the 8th March, so will that be okay within the notice period?

8th March is exactly 4 weeks away so you need to hand in your resignation today.

You don't have to pay back SMP. You can't be paid smp and work tho so once you start the new job you can't receive smp for the same period of time.

Thankyou I don't start the new job until 8th March so my last day At my current job is 7th March will I still be on SMP until then or on my actual wage ?

If you have passed 39 weeks of your maternity leave by that date then you will be in the unpaid portion of maternity leave so you won't be earning anything

My maternity date was supposed to end on 11th April I'm currently going into my 31st week

To give 4 weeks notice to your employer you needed to resign yesterday.

You will continue to receive SMP through your notice period and it will stop on the last day of your employment. From day one of your new employment you will no longer receive SMP and instead receive the wage you've agreed with them.

But you needed to resign yesterday to make the four weeks to leave on the date you said.

I've handed in my notice other day and my leaving date for the current work is the 7th and I start my new job on the 8th, but I have 11 days left for holidays as well
