Recruiter has misled me on job pay rate

Was called up by Hays Recruitment for a job within NHS.
Have been trying to find part time job for 3 months to fit in around existing job which I don't do for 11.5 hrs. It has proved much harder than I expected so was really pleased to be offered role. Recruitment consultant super friendly - gave me all details and told me the rate was £12ph. This was a better rate than other jobs available so agreed and was quite pleased and happy to start on Thursday at location. Spent Thursday and Friday there both days getting all relevant passes and ID sorted for access to their system - this took a LONG time so also did some online training and bits and pieces to help out in the office while waiting. At 3.45pm on Friday, received an email with attachment from Hays. Couldn't download the attachment at the time and thought I would do it when I get home (ie not in work hours). When I opened it it said : Assignment Confirmation Letter
Premium Rate - £12.10 ph

Statutory Holiday deduction £1.30 ph
Working rate - £10.80 ph
(less NI deductions of course)
So they send me this after I have done 2 days "work" and I feel completely misled. The rate is £10.80 ph and not £12 - I have emailed back to say I want to speak to them first thing Monday and I really want to tell them to stick their job. I hate letting anyone down (ie NHS) and I know that the last 2 days will have been a complete waste of time for my "new boss" and she will not be happy. But I just feel this is underhand and deceitful.
If I don't carry on I am then without a job and back on the market looking and I feel so disappointed and annoyed. What would you do?

I personally would keep the job. An agency I used to work for would say "rates of pay £12 per hour" when in fact that was the highest rate of pay for nights, not days. They wouldn't tel potential day shift applicants because they wanted it to seem attractive, very misleading.

Have you signed a contract that states your hourly pay is £12?

The info is all on hays website re premium rate holiday pay etc. I suspect it will be because it's a temp job.

No they hadn't sent me a contract yet. Googling reviews for Hays this seems to be the way they operate. They wait till you have got established into the role (ie too far in to back out with ID clearance etc)
then they tell you the rate is lower. The consultant verbally told me the rate was £12 per hour. There are no night shifts it is an office role.

Are you sure you won't come out with £12.10 an hour? That reads to me as if the base rate is £10.80, to which they add £1.30 holiday pay making the actual rate £12.10.

Which is exactly the right way of doing things if you do an hourly paid role where you don't get a paid holiday allowance - which is normal with agencies.

That's just the holiday pay element of the rate at 12.06%. You may be able to opt to take this weekly which would bring your rate up to £12+ but then you won't get any paid holiday. Some contractors, particularly on short term contracts or part time, prefer to do this. Not strictly what the agencies are supposed to do though, but as long as your payslip clearly states the breakdown between your rate and the holiday pay element, they can offer this.

You should have been given a KID (key Information Document) before you started this contract which would have laid out clearly your rate and any additions/deductions. The agency really shouldn't have let you start your assignment until you had read and understood this document, and returned a signed copy to them.

I had this with Hays. I was offered a job for three days and they deducted 'holiday pay' in the same way. Like I was ever going to accrue enough holiday pay in three days' work to be able to take a day off. It is so misleading. And yes you get the money back eventually (or take holiday if you're in a post long enough) but other employers advertise at £12ph with holiday on top. It's a legal requirement that you have paid holiday. It's a really shoddy practice of Hays

Yes, I googled the Hays website as well and it looks as if you have an effective rate of £12.10, you just won't see the benefit straight away. I'm just a regular contractor so I charge for each day worked and on any day I take off I get £0. I think you will get £10.80 for each hour worked, and get paid for days you take as leave (it says "1 holiday hour is accrued for every 8.29 hours worked."). So that works out the same as getting paid £12.10 for hours you work and nothing for any days off.

Thanks for the info Masdintle - I think it is very shoddy practice. In this case it will backfire on Hays because I feel I have been completely misled by the consultant.

Thanks - I have worked for agencies before and you accrue holiday but never has holiday pay been deducted from your daily rate. Hays are probably charging the NHS double the hourly rate I'm getting.

I am beginning to wonder how many Hays employees are on this thread because they seem very quick to defend Hays The recruitment consultant misled me and offered me the job at a rate of £12 per hour - it was deliberately misleading on her account and appears to be the way Hays conduct their business. Now I have had time to look at more of their reviews.

I work for an agency and accrue holiday pay on top of my rate. I get paid what they offer me. I agree with you that Hays is working slyly.
They should be more clear.

a 2 second spell checker would have corrected your message from a worker of "hats" (but never mind) - and a very useful document Hays didn't issue me with - another example of their underhand way of operating

But still Google is your friend here. It's common jn temp jobs, as you are still entitled to holiday pay. I've seen it before where the temp employee gets it paid each pay day but then doesn't get holiday pay when you take holiday.
