Desperate for Part time / declined

I work for an airline

I had maternity leave then career break attached. I recently returned to work and want desperately need part time but I keep getting refused because of operational reasons.

Anyone else had the same issue?

Yes, at a college. They already had people with my job title as part time after mat leave. They didn’t want more, but they couldn’t justify it with real business reasons. They also didn’t bother even trying to justify it. They just said no. Tribunal. I won!

What operational reason have they given and have you followed the appeals process?

There’s a list of justifiable operational reasons they can use and it sounds like they didn’t give PP one of these. If they’ve given one to you unfortunately I wouldn’t get my hopes up too much OP

Summer 22 demand is the reason however I feel it's unfair because I have a young child surely i should flexible working should be allowed if you have a child to look after? I'm looking into it

Flexible working being granted doesn’t rely on the person who is asking’s “need” fir it. It relies on the business being able to accommodate it - if they have valid business reasons to say no (because it would affect operations) then they can deny it regardless of whether you want it to care for small children or live the high life playing golf/lying in bed/painting/whatever.

When you say you keep getting refused have you submitted a formal flexible working request and had it and an appeal refused
It's relatively easy for an employer to turn down request for part time as long as they go through the motions

You're personal reasons for wanting part time are pretty much irrelevant, and people without kids are allowed to want to work part time too!

You need to justify how going part time won't affect their business and your ability to complete your role. Honestly, i can't see many airlines agreeing to flexible working requests right now after covid and ahead of the busiest time of year

Is job share a possibility? Any one else in your position at the same grade where you could collectively share a full time position?

They can refuse for business reasons

You are not entitled to work part time because you have children

I would put in a formal request and see what the formal outcome is
