i live above where i work and rent comes from my wages. When i was on maternity leave obviously it stopped coming out. I spoke to my then area manager who said as my dh worked for the company it could come out of his. Well it did not and now they make me pay the back rent each month it is crippling me i bring home £145 a month is there anything i can do

Stop paying it, write a letter offering them a reasonable amount per month, 10 pounds say.

If they refuse, do not pay another penny other than your rent ( I shouldn't say this but don't pay anymore, wait for the eviction). In the meantime, make sure you have enough money for a deposit on another place.

Are you planning to go back to work for them??

i already back at work and money comes directly out of my wages so i cant stop it. The company i work for own building

Right, that sounds a bit intimidating. You have to write to your Managers and state that you cannot afford it. Ask for some time to settle what you owe. If they say no, go to Citizens advice. It's not right that if it was their mistake you are paying all of that. You have your landlords by the bollocks if you are living there with a child. They can't really say no.

thanks wifi problem is because they did not let me know for nearly six months i owe nearly £5000 they have just recently in june dropped rent from £105 a week to £35 a week because of a similar case where butlins employees to them to court because when they took the wages out it dropped below minimum wage. Its just so depressing. They are a massive company its not if they need the money

Whilst they did make an error in not deducting from your DH's wages, I am presuming neither you or your DH informed them that the payments were not being taken? You would obviously be aware the rent money was not being taken and could have saved the money whilst the problem was being resolved.

Why should the company accept instalments if you have been living rent free due to an admin error?

because when this was all going on i was not actually in the country and my dh presumed it was still coming not of my salary. I fully accept i owe money but find it hard paying back so much.

Unfortunately despite being their error it is still your responsibility.

You do need to take advice on this. It is a matter of looking at your income and expenditure to sort out your expendable (?) income. Most people will not do this properly on their own.

Your local CAB should be able to advise you.

One other thing, you mention they took six months in notifying you. This adds up to £2730, not nearly £5000. It's none of my business how long non payment went on for but make sure they are not adding interest or other charges, if they are you definately need to seek legal advice.

WOrk out what you can afford to pay each month towards clearing the back rent and make them an offer - if they won't accept it, seek legal advice. Frankly they sound dodgy anyway.
