Mis sold a job role?

Hi everyone,

I'm wondering if anyone knowns a little bit about this more than I do.

In September 2021 I left my job as a support worker to become a Team Leader at another company but same kind of organisation (support work/care). During my interview, I let the manager know I had a son who I am the primary carer of and is 5 years old. She reassured me we could work something out and I managed to be successful and got the job!

We were emailing back and forth, I was then asking the sort of responsibilities and hours I would have etc and luckily I got it all in writing: she said 19 hours would be office hours and 19 hours would be general support work. I was really glad, I had done support work in the past and was ready to learn new skills and take on more responsibility and essentially manage a team. She also (As stated in emails) said I could divide my office hours up over as many days as I liked - brilliant, exactly what I needed.

Brilliant, over the moon, right?! WRONG.

That manager left and went to another company and I spent a lot of time off sick. Upon my return to work and new manager, I was then informed that I do NOT get office hours as a team leader and that I MUST BE FULLY FLEXIBLE MONDAY TO SUNDAY as per my contract.

Clearly annoyed and frustrated by this, I forwarded the emails with the original manager onto the new manager but they said nothing can be done? I explained I would not have accepted this role under the impression I must be fully flexible and do not get office hours as I had no reason to leave my other job?

Where do I stand with this?

What does your contract say?

If there is HR I’d say speak to them. You haven’t been there long enough to apply for flexible working but you have it in writing what your job role would entail.
Maybe the new manager has misinterpreted your role?

So have you actually started this job yet ?
Is this flexible working in your contract ? If you’ve not started gone off sick for a long time ( your words) things may have changed new manager and everything.

Is it a community care agency?

If so I would question how you can lead a team without any office hours. If you're purely out on care calls would you even come into contact with most of your "team"?

Could it be that the new manager is cautious about providing flexibility as you were off sick for a long time not long after starting?
