Is this discrimination?

I have a colleague is constantly talking about me behind my back. I have multiple chronic illnesses so I can't constantly stand up and do loads of things. Because of this he tells the other staff that I'm lazy and I don't do anything and that I'm not fit to work at the store. This is pretty upsetting as I can't help my disabilities and I try so hard to do us much as I can. I have had a meeting with this person about this and he did apologize but he's now at it again. Should I go higher up with this or leave it?

Yes, you should raise this with your manager. Your colleague shouldn’t be speaking to you like this.

Yes, they’re bullying you for not being able bodied so that’s definitely discrimination.
Gather evidence if you can and go to your manager. So sorry this is happening to you Flowers

Absolutely take it up, escalate to a higher manager or HR if you have to. In this day and age it's simply not acceptable to make these kind of comments especially when's it's been made clear to him it's hurtful and he must stop (not that ignorance is an excuse anyway), what reason does he have for continuing with this behaviour Angry .

Where I work we would take this really seriously and given he's had an (informal) warning he could potentially be looking at a final warning or dismissal if what you've said is correct (obviously hearsay has to be taken with a pinch of salt and his side of the story would be listened to as well). Please do stand up for yourself but also for all the other disabled people out there (you bet your bottom dollar he makes these kind of remarks about others too!)...

It is disability related harassment so that's what you need to say in your grievance, as well as saying you are raising a grievance.

harassment is covered by the Equality Act

Make sure you have dates and names of anyone who witnessed his behaviour (even if they don't want to get involved, tough, they can still be called on to give evidence)
