Just do not know what to do

I'm in a awful sales job where I thought I'd hate it from day 1, never mind meet the targets expected and dare I say it the Employer feels slightly bullying or intimidating. (it's one of those places where you can't even go to HR) I wish I had been a chugger in a past life to know how to handle this.

I put my 1 week notice in 8 days ago (their handbook said you could leave with immediate effect provided you agree to pay only up to that point which was absolutely fine with me) however the call centre management had different ideas saying I should stay until I had a firm job offer. They want to be seen to be helping but it's bit of a front, it's behavior I just do not understand. It's like the Employee cannot decide for themselves they cannot do the job required. It's a head f##k.

Anyway in 'staying on' until the date of their choosing which amounts to more than the week's notice, they've blocked me requesting any annual leave and engineered a stressful situation on Christmas eve where I could do no work. It created a time for them to let me know whatever I said in training had got repeated, about how they should test a potential new employee's internet speed before giving them a WFH job. (there had been problems at the start where it came to light 2nd week of employment my internet couldn't handle a dialler telephone system so went through upgrade but of course this took time)

I need to leave - I've accessed savings and have more job interviews lined up for different roles that isn't sales at awkward times of day that just don't fit in with the current working pattern. I just wonder what conversation I need to have now - it is better I play along I've had a job offer made over xmas and need to go avoiding any more unpleasantness? The team manager can be heavy handed because they are targeted on staff retention, attendance and performance.

Over the last year I've just got myself stuck in sales role after sales role pretty much - I would now like to get this off the CV for the future so I don't get pulled into sales again - do I just write 2021 as not in employment. My problems started when I had a steady admin job throughout all of 2020 until the point the Employer went for furlough fraud so regret everything that has happened over the last couple of years.

Sounds awful and I sympathise. How much longer over the 8 days did you are agree to stay? I don't know the legality of your situation, but ACAS might help. I'd hope you can revoke the extra time and just leave after your 8 days, or where needed take sick leave if you have any left.

In a previous job, I was allowed time off for interviews, but, that might have only been applicable where the role became redundant, and likely not the case just because you want to leave.

Qwertykeys · 28/12/2021 13:13

I would leave as soon as your notice is up , as per the handbook

SimonedeBeauvoirscat · 28/12/2021 13:15

Why on Earth did you agree to stay longer than you need to?! Just tell them you’re reverting to your original notice period and stop putting yourself through this! It sounds as though you’ll feel a lot more clear headed once you’ve been able to get out of there.

insancerre · 28/12/2021 13:17

Walk away
You’ve worked your notice
I’m sure you will feel a whole lot better

anniegun · 28/12/2021 13:17

Why are you not leaving after your weeks notice. They cannot insist you stay

CorrBlimeyGG · 28/12/2021 13:25

What's the worst that can happen if you tell them you're ending your employment today? How long have you been there, around six weeks?

Userxxxxx · 28/12/2021 18:59

Thank you so much for all the guidance.

I really wanted to go last week but got talked around however briefly as I hadn't a firm offer elsewhere (wasn't quick enough to just say otherwise even with it not being true) and I suppose they need Christmas annual leave and possibly Covid sickness covered. I knows it puts me on rocky ground that so next week I'll go I'll be off, with nothing in writing to acknowledge the attempt to leave they could turn around and say that will be a week further served please.

I also have to be really honest in nearly 23 years of work, I've been so lucky, just never having the situation and finding it hard to deal with where the manager's bonus and performance can be affected.

Thank you for listening and your time today.

I was in a job I hated for 2 years, handed my notice in and said I’m leaving today- nothing happened . Just tell them you’ve worked your notice and won’t be going back.

Ilikewinter · 28/12/2021 19:18

Just dont go back, youve served your notice and thats that, i dont understand why you want to commit to anything more in a job thats causing you so much stress.

Bushkin · 28/12/2021 19:22

You’ve worked your notice. Just send an email that says as you have now worked your notice period you’ll be leaving with immediate effect.

FawnFrenchieMum · 28/12/2021 19:24

Do not lie on your CV, most companies expect you to prove your employment over the 2-5 years and if you have put unemployed they can ask for bank statements to evidence you didn’t have a salary coming in. They will think you are trying to hide a reference request.

They can ask what they like, there is absolutely no legal obligation for the OP to do any such thing. I have never heard of such a thing as having to prove income to a future employer - they may ask but they'd be CF trying it on, and you'd have to be on the bones of your arse to agree to showing them anything.
SNUG2022 · 29/12/2021 04:41

I echo the pp. Just send an email stating that you gave your notice on X date to leave on X date, and as that date has now passed you will be leaving with immediate effect, and they should take X date (the last date you actually worked) as your last date of employment with the organisation. They sound like complete fuckers, who are obviously struggling to recruit for some reason...

SNUG2022 · 29/12/2021 04:42

Also state this was per the handbook.

SNUG2022 · 29/12/2021 04:44

You could even say thank you for accepting my resignation and your kind offer of employment past that date, but this will not be necessary. Kind regards.

Op ignore this, since May 2020, Ive worked for 4 different places. Some I’ve left some where I have been let go. 2 of them aren’t even listed on my CV. Lo and behold I start a new role in January. 5 jobs and only one asked me for dates of employment for 5 years. Never asked for previous salaries, so they only knew the salary of my previous role (as they should do with my p45). So some companies, like financial institutions do this but definitely not most. A reference request will most likely be the referees of jobs actually listed on my CV.

Thank you so much again for replying.

Oh boy I needn't have worried.

On Wednesday toward end of the shift, it came to a head, something happened (but it was the kindest thing) which made me get decisive and with that switched off.

I have now heard from HR with them accepting my resignation, but only from Wednesday's debacle.

I forfeited the small commission I'd earnt because in HR's view I hadn't worked notice and well they've most kindly arranged a courier to get their equipment back which I'm just grateful at as it should have been my responsibility to return.

Had an interview yesterday which I so very nearly cancelled - but ended up successful in for customer service! Seems they might do a dbs check only but in the end if I had to come clean about the sales role in this instant then I will.

I hope to get a couple of years settled now most definitely with my 2nd chance at C/S and then just lump 2021 as working various sales roles. I did read you can put what you like on the CV but be careful with formal application forms as it were.

Thank you so much for helping Tuesday xx

Ah im pleased for you OP, congratulations on your new job....new year new start!

Vapeyvapevape · 31/12/2021 17:04

What a relief and well done on your new job . It’s hard sometimes to see how to navigate situations, especially if like me, you panic and then it all becomes a muddle in your head .
I’m so pleased it’s worked out for you x

insancerre · 31/12/2021 17:25

Good news!
Don’t worry about the dbs, it’s not to check your employment history, it’s to check your identity and to check if you have any criminal convictions

WutheringHeights66 · 01/01/2022 09:01

Well done 👏
