Flexible working. Dp told he can do this, but then they won't let him!

Dp applied to work from home one day per week.
Boss agreed.

However it isn't happening. Dp constantly pulled into meetings (an hour's drive away, and anothet hour back), on the day he is supposed to be working from home

Also told that he needs to get in to finish some stuff off. Despite being told he can work from home one day per week, it never happens.

He has spoken to his boss twice about this, who always says it is OK and yes he can work from home,then appears to "forget"about it.

What to do?

Am not an employment lawyer but I think...

In general, employers do not have to agree to flexible working, they just have to give it reasonable consideration.

Once it has been agreed, then I think you need to consider exactly what was agreed. Was it that he could work from home when convenient, or was it formally agreed that he can work from home 1 day a week?

If the latter, then I think your position is better. How you deal with it depends on what his relationship is with his boss. Next time his boss asks him, can your dh not just say "that's my working at home day", I will do it the following day?

fizzbuzz did he make a formal flexible working request under his legal entitlement to do so? If not, he should consider doing this. See here for more information.

Regardless of that, I would suggest he requests a meeting with his boss to discuss how his agreed working from home arrangement is going. Your DP should request that meetings he needs to attend are scheduled for days he is in work, and that everyone relevant is aware of this. He should also discuss with his boss the best way to address the 'stuff not being finished' issue. If there is genuinely stuff that needs doing that is not being done according to deadlines or whatever, then of course that needs to be addressed, but deciding the day before that your DP cannot work from home on his scheduled day isn't the way to do it.

It may be a difficult conversation to have but there's really no way round it if your DP wants to sort this out.

Thanks for all help. He hasn't made a formal application as he only started in March, but his boss agreed to it from day 1.

However his previous job was very very flexible, basically he could work from home whenever he wanted. He was reluctant to leave that job because of this, but he explained twice to this company how much he needed flexibility, and they agreed before he started.....but now they are being difficult, although they don't think they are doing anything wrong.

It isn't in his contract, but it needs to be. TBH I don't think the company he works for are even aware of the laws about this. But they would still be like this if it was in his contract.

No union as small crap company........

If he only started in March he doesn't have much in terms of rights at the moment. I would suggest he reads up about making a formal request for flexible working and thinks about doing this once he has been there a year.
In the meantime although he doesn't have much in the way of rights he can and should still have that conversation with his boss.
