Been told to do training before Xmas, then manager declined it due to workload

My manager has told all staff that they must complete a training day before Xmas. I booked in for it, now boss saying I can’t attend due to staff workloads. He is suggesting I do it on my day off with no time owing! Is this legal?

It's a suggestion. Time for a reasonable discussion with your manager.

Can you ask if you'll get your 1 day back in the future? If so I'd get the training day done and book the substitute day in calendars.

If your day off has implications on childcare then bring that up in your discussion, and point out the reason for you not working on a particular day is due to child care responsibilities. If your manager doesn't get that, I'd be amazed!

If they sack you over this, then that would be illegal.

What do you mean by "with no time owing"? Are you saying they've actually stated you must do it on your day off but you won't be given a substitute day off?

This sounds way more complicated than it should do!

I would ask them to confirm they are taking you to do it on your day off and you can not attend the booked training, in working in an email.

violetbunny · 26/11/2021 05:37

I would just say you're unavailable on your non working days due to other commitments, so they need to prioritise what's a more important use of your time within your working hours - attending training or working?

Manager said I need to do the training on my day off and I will not get any time back. Reason being due to staff workload. I have worked there for years. New manager 😬. I am a good worker, very rare day off sick in years. No issues highlighted with my work or performance. I will challenge it but not sure how to approach it. It’s really opened my eyes that I am just a number and they don’t care.

Your new manager is an ass.
Lots of opportunities in retail at the minute, I'd go back and say he can pick the day but you will not be doing the training in non paid time, so what should you do ? In fact I'd email it so there is a trail.

SMabbutt · 26/11/2021 10:20

Did they refuse to let you attend the training and suggest you do it in your own time in an email? If so respond to the email and cc it to whoever instructed you to do the training stating that you accept the instruction to forego the training day but will need to be allocated another working day to complete it as soon as possible.
If it was verbal then send an email stating as discussed on date I understand that due to workloads you are unable to allow me the time to do the mandatory training on this day. Please can you confirm a suitable date. My working hours are xyz. Thanks.

notapizzaeater · 26/11/2021 16:03

Would adding the hours training but not paid bring you below minimum wage ?

Mintlegs · 26/11/2021 17:05

Not not on minimum wage. Yes got email refusing training after manager suggested training! Asked her about it today. I believe she is faking it until she makes it (new manager and new to the company). Cannot make one single decision, after ‘checking’ I can now do the training that I needed to do as part of my specialised role. She’s ticking boxes; this won’t end well! 😂 Such a fuss made by her, totally unnecessary. Some good advice! My rant is over, thanks! x

Sorry you went through that, clearly she doesn’t know her arse from elbow. Anyway, I would have refused and said “work training is is work time, sorry”
