Settlement agreement

I have been put under consultation for redundancy to suit the needs of both me and the business. I know the annual budget included my salary to the end of the trading year (31/08) AIBU to want my salary to end of year as part of my settlement agreement?

Your salary is probably part of the reason for consultation.
The budget can be set but they might not be able to afford it.
That’s 9 months salary, more realistic is probably your statutory and maybe 3 months salary

I have a 3 month notice period and stat as the basic, I want to be negotiating more

MultiStory that's what I'm thinking, aim for somewhere near

Well, to sign away your statutory rights you’d expect something more than your notice and stat redundancy pay. How much depends on a lot of factors - do you have any leverage?

Shedmistress · 14/11/2021 20:37

You can want what you like but why would they?

How long have you worked there?

EBathory · 14/11/2021 20:50

I've been there 10 years, and have possible claims

3 months notice plus 3 months salary is a typical 'start point' for (lawyers) negotiations if you have claims like harrassment etc.

6 months salary + 3 mths notice would be considered very good, but sounds like you are pushing for 9 months which is unrealistic (unless you see that as 6 mth salary, 3 mth notice)

If you have claims, you might need to explore pushing those to get more (eg see a solicitor, write a grievance etc). Is this a normal redundancy consultation or a pushing out disguised as redundancy?

EBathory · 14/11/2021 21:08

This is a complex redundancy situation and I'm trying to find out what might be reasonable.
I have a meeting in the morning to discuss further and would like some kind of reference point for any offer made

Are you the only person being made redundant?

Snipples · 14/11/2021 21:13

I'm an employment lawyer and In practice rarely see ex gratia payments of more than 6 months tops and usually for the most senior directors where there is a commercial need to have them go quietly. In a redundancy situation the norm is about 2 months gross pay on top of stat redundancy pay (enhanced if that's the company policy) and then notice/ accrued leave. If you work your notice there is no payment in lieu either.

If others are being made redundant also the typical payment is usually lower as all affected employees will get the same or similar deals.

As a reference point , 3 months pay + 3 months notice (paid in lieu) would be typical assuming you are mid level/moderately senior and given your years of service (according to employment lawyer consulted).
EBathory · 15/11/2021 07:49

Thanks for the advice, I can walk into the meeting this morning and have an idea of whether the offer is reasonable.

I need to see the final offer as there are various parts of my package to evaluate. Professionally it is on good terms with agreed media release etc.
They were not prepared for me to say yes to the redundancy, they expected me to come to the meeting with other solutions

DespairingHomeowner · 15/11/2021 14:34

@EBathory: good to hear a (relatively) positive update. What other options were they expecting- a transfer? Just wondering how things were expected to go

EBathory · 15/11/2021 15:32

They wanted me to reinvent a role for me after being off for several months

OP posts:
BonesInTheOcean · 22/11/2021 21:19

Did they make an offer?
