Can my partner still get Shared Parental Leave (SPL) if I quit my job during my maternity leave?

Hi everyone,

I am planning on sharing parental leave and pay with my partner because he's got a great paternity package (6 months at full pay), whilst mine is rubbish (statuary), among other things.

The plan would be for me to stay with the baby for the first six months and for him to stay with the baby after those six months. I understand this is possible, however, I would like to quit my job after my six-month leave and I am wondering if I quit my job before he starts his shared parental leave whether he would lose this benefit or not.

I'm struggling to find an answer to this question on the government's website and citizens of advice, so hopefully someone here will have an idea about this!

Statutory Maternity and Shared Parental leave & pay both have eligibility criteria. Once you meet the criteria and commence maternity/shared parental leave you get the full entitlement of leave and pay.

So your husband should still get paid statutory, the occupational top up will depend on his contractual entitlement. However, it would be very unusual for an employer to not pay the occupational in the circumstances you describe.
