Employment rights

DP is looking to change roles but within the same company. He has been there for almost 4 years. If he changes roles within the company, does he keep his employment rights or do they start new?

If he has continuity of employment under contract with one employer, then his employment rights in terms of pension, redundancy pay etc continue.

Obviously his place of work, hours, responsibilities and pay may change.

If he is employed as a permanent member of staff, moving roles wouldnt normally change his existing contractual rights.

He should ensure he gets this clarified before making the change to a different role, plus get HR (whatever form that takes in his company) to confirm in writing

  • his new pay
  • his normal base office location
  • that he has continuity of employment including annual leave, pension, benefits if any and sickness absence pay.

If he isn't permanent staff then he needs to clarify the situation based on the contract he's covered by Eg Fixed Term, in case there is some extension to the term, or if the extant term remains unchanged despite the role change.

Having the above in writing is important as he will have a change in reporting line so he needs to be covered for all eventualities.
