Looking for some advice as searching online hasn't really helped and know how amazing and knowledgeable people on here can be!

I'm a teacher and on maternity leave. Didnt take the extra pay just the satutory as didn't plan to return. Resigned a few weeks ago as per term deadlines for resigning and put end of December as my end date as I would have done if leaving the job to go to another one etc.

Have now been contacted to ask to re send letter with a new end date on it. That date being the day my satutory pay runs out rather than later on (which would be part of the unpaid maternity leave that you can take).

My questions are.. is this usual? Why are they asking me to do this when that time period is unpaid anyway?
What implications does doing this have for me?

This is probably a stupid question but what about National insurance, pensions and other benefits like death in service etc.. if I am not employed then all of this is gone... so would I not want to hang on to it even for the 3 months difference? Or does it not matter because no wages means no pension and NI anyway?
Googling this talks a lot about annual leave accural and I'm sort of aware of teachers managing to get paid for annual leave from some threads I remember reading before but not sure if this would apply to me anyway?

Would be really grateful if anyone can offer any advice. Plan to call HR this week and see what they say but would rather call with some idea of what to say and discuss/check first.

Are they asking you to send a letter with the date your maternity leave actually ends on?

Holiday pay & pension... you'll get more of each if you finish on your proposed date, they can't force you to resign earlier than you want to

They can if her mat leave finishes earlier than her proposed resignation date and she refuses to go back for the remainder of her notice period

Thank you all. I also have in my head that the longer that I am employed the better...

My maternity leave doesn't run out before my resignation date, just the paid part (9m ish) rather than the 12m you can take... hence my confusion over why I am being asked to alter my letter. They want me to re send my letter stating a resignation date for when the money runs out not when my 52 weeks does...

For clarity, the date on your initial resignation is the same as your original return to work date?

@girlmom21 so I put the 31st Dec.. my maternity leave had to end by the 3rd Jan anyway. But teacher resignation deadlines deal in term blocks so went for the 31st as per those rules.

@girlmom21 sorry for not being clear enough. There wasn't an agreed end date before I went on maternity. We all knew it was likely I wasn't coming back.

The key dates are... 8/10/21 my satutory maternity pay ran out and the date they now want me to put in my new letter.

31/12/21 my initial end of employment date given by myself in my original resignation letter. Also the common date that would be given by any teacher wishing to resign a post in order to not return after the Christmas holidays.

3/1/22 the last possible day of my maternity leave.

If I had been going back to work I would have arranged to 'go back to work' on the first day of the Christmas holidays in order to be paid for them and return to the building properly after the holidays were over. This is what teachers can do as they don't accrue annual leave in the same way. But this was never discussed as it wasn't really relevant.

The latest day I would have to go back to work by though would be 4/1/22 as my maternity leave entitlement would be over.

Ah ok so they want you to put the day your maternity pay ran out then. I don't think they're unreasonable to ask you to do that as they've probably planned for you to return to work at that time (officially, even if you told them you probably weren't going back) and will need to arrange cover from that date.

When I went on maternity leave I had to give a day when I'd be returning (which is when my SMP ends) even though I was entitled to the full 12 months obviously, like you.

Could you withdraw your resignation, ask to extend your maternity leave to 12 months then re-submit your resignation in a month or so?
