Change of rota

Hello all, I need peoples ideas/thoughts on these matters.
• is ones day off meant to be changed without ones knowledge? (I have knew I was off on a particular day for at least 2 weeks and I put it done on my phone because I do put days off on my phone. Only for my to check this morning & found I was now booked to work on d day I was to be off. I was not informed or told. I asked a more senior person and he said he does not know). If they were going to change it, should I be notified?

• work involves a lot of calls & I told a senior person at work that I would will going quiet because a tree surgeon is pruning my is neighbours trees and the machinery is very noisy which means I won't hear clients and they won't hear me & neighbour said it won't take more than X amount of mins but he decided that period would be unpaid? Is this appropriate?

• how long can timesheets go for without approval?

What does your contract say about working days so for example my teams would say monday- saturday 8am 9pm that means a shift anytime in those days days off can change however also says in contract 4 weeks notice of rotas I cant change their day off within those 4 weeks and if i need to i ask if they can swap their non working day. I wouldnt swap a non working day without discussing with them out of courtesy but depends on the contract wither your boss is considering that or not.

If your paid to take calls and cant do your job then its unpaid

Point 1: it depends what your contract says about notice for shifts. It sounds like you work different days each week rather than for example Mon-Fri every week. In which case, check how much notice it says in your contract. My last job they only had to give me a weeks notice so your scenario they would have been able to do (it's one of the reasons I left the job - I couldn't make plans as my shifts were constantly changed)

Point 2: Yes they're fair enough to say it's unpaid if you can't do your job for however long. Background noise is part of working from home just now, it isn't really your employers problem that your neighbours are making noise. You can't just tell them you won't be doing part of your job for x amount of time and expect them to still pay you for that.

I have no idea about point 3, sorry!

The company allowed us to see the contract which I skimmed through with the hope of going back to it later & we are not allowed to print it off . But to my surprise, when I checked my work account again, it wasn't there when I logged back in again and I asked a colleague who said one as to email HR to get a copy but I haven't yet but will do that ASAP

Also, I saw they were asking/appealing to people to swap shift today so I guess they haven't got contractual rights to change peoples shift without informing them. Right?

I'd definitely get on to that asap, as far as I'm aware, everyone has a right to a copy of their contract, whether by email or a paper copy. I don't think they can legally say you're not allowed a copy of it. It should be the contract you signed too so that they can't just change it without permission.

It depends on the shift swapping, if for example it says in your contract shifts can be changed with a weeks notice then if it was shifts for today or the next few days they were trying to swap then they would need people to agree to a swap because it's within the week if that makes sense?

How are you paid? If hourly and you are unavailable for that hour then it probably would be unpaid or you take your break over that time/make time up. On a headset most would eliminate the worst background noise.

Your contract should cover how far ahead shifts are set or any alterations notified. Or it may be that there is a raft of hr policies online covering absence, hours etc

They allowed you to see your contract? You’re legally entitled to a written terms of employment! So yes, you need a copy and they can’t say you can’t print it off. They sound awful, I would remind them of their legal obligations. If you look on gov.uk it sets out what must be included such as hours of work and how they can vary.

On the issue of timesheets approval do you mean they are not paying you? I wasn’t sure how to interpret the question. The written statement will also include when you get paid

@Leftbutcameback thanks a bunch they are paying me but 2 weeks timesheet pending not approved yet. I assume it's passed on to the payroll once approved for payment and if not approved, how will payroll pay?

@LIZS I get paid hourly rate monthly and when I asked if I could skip my last break to make up for the time lost she said no. Is not about unpaid time that bothers me but I want to know what is allowed/reasonable and what is not. I have worked in family business all my life so not use to working for companies 🤦🏽‍♀️🙄

Is there a deadline for approving timesheets to meet the next payroll run? You may find they get approved as a batch.

Ok, well Acas can give you free and accurate employment law advice whenever you need it. Might be a quicker and more reliable source than taking advice from randoms online.

No harm sounding people out when all you need is a fresh perspective on an issue or signposting to resources, but when you have actual legal questions it's not the best.

Their website also has lots of trusted information that might be useful if you're unsure how an employer should behave or how you as an employer should behave.

That's why you need your contract - it should say how and when you are paid. When I used to work for an agency provided the timesheets were submitted by a certain date then you will be paid the following week. That's just made me think whether you are actually employed by the people who run the business or are you an agency employee?

Also if the timesheets are submitted and processed and approved electronically is there a process for somebody to sign them off when your manager is on holiday? We can choose an alternative approver on timesheets.

I'd say it depends entirely on your contract. From what you've said it doesnt sound a great place to work. I think I'd start looking for a new job.

I still haven't had the chance to read it but it was confirmed that they changed my rota in less than a week without notice. I made it clear that it was not acceptable at all but then, what else can I do other than that? I know they will ill do it to someone else or try it with me again. Is there any way of handling this matter other than verbally? Shall I write to them?

You need to read your contract!

If you then think they are breaching it, call ACAS.
