Immediate notice?

My partner has secured a new position. Anyone who has seen my precious posts will know this is a definite improvement on our current situation.

However they want him to start tomorrow. Can he email to say he quits his current job straight away?
What will happen?
There's no way of not taking this job. It sorts us out so well financially.
Any help.

He can quit with no notice but the current employer can sue for the cost of not working their notice; does he get sent sense of whether they will do this? And they can put breach of contract on the reference. Why does the new employer want him to start immediately, they must surely have asked what his notice period was? Has he told them he is not employed at the moment?

Hes a low level chef at a bar. They needed someone with immediate effect. That's all I really know. But the wage compared to now is just something we can't turn down. It's like a light in the tunnel for us after this year

Hospitality are crying out for staff right now so as a chef he would be in demand.

OP how long has he been in current job? Does he have a contract?

Worst case scenario is they:

  • withhold any outstanding pay
  • sue for breach of contract (they can do this through small claims)
  • give bad references in future

If you are willing to roll the dice on these and risk them then go for it.

Only contract he has is one he says he's on a 30 hour a week contract. He's been there about 18 month but only really actually worked there cos of covid about 8 months. He's done other jobs in between like 2 jobs at once to supplement our income. The new job is in a restaurant but its better hours and pay. At this job he was doing 13 hour days. He never saw me or his daughter. This one is 5 days a week at 8 hours. With a much higher pay. We can't really say no. This is what we've been waiting for

Only thing to consider is it's good to leave on good terms, and by that I mean offer to work some notice, if there's a chance this job won't work out and he would be happy/prepared to go back to his current role.
