If you were given 4 weeks notice of redundancy on 15/06/21, when would you expect you last day to be? Thank you!

13th July?

ATowelAndAPotato · 04/07/2021 12:28

12th July would be last day of employment if it was definitely 4 week’s and not one month?

AmIatotalthicko · 04/07/2021 12:35

Thanks. For info, I only work Tuesdays and Thursdays. So I was given notice on Tuesday 15th June. As @AllTrolledOut thought, I thought my last day was 13th July.
It is 4 weeks not a month.

13 July. Notice starts the day after it is given.

flowery · 04/07/2021 12:36

What’s actually happened OP?

CherieBabySpliffUp · 04/07/2021 12:43

1st week of notice 15/6-21/6
2nd week 22/6-26/6
3rd week 29/6-5/7
Final week 6/7-12/7
So last shift Thursday 8th July.

AmIatotalthicko · 04/07/2021 12:44

Employer is saying I am due to finish the previous week. I am honestly so tired of this shit. I need the money, even if it's only an extra day as I haven't got another job yet. I am supposed to get redundancy pay too, but I will believe it when I see it.

OP posts:
AmIatotalthicko · 04/07/2021 12:47

But surely you haven't had a week of notice on the day you were given it, @CherieBabySpliffUp?

BillyIsMyBunny · 04/07/2021 12:58

I’d expect Monday 12th July to be the last day I was officially employed and my redundancy to start on Tuesday 12th July.

BillyIsMyBunny · 04/07/2021 12:59

Sorry, Tuesday 13th July to be first day of redundancy/ unemployment.

CherieBabySpliffUp · 04/07/2021 13:08

4 weeks = 28 days
If you count 15/6 as day 1 then 28 days from is 12th July so would be your last day of employment. Your last shift then would be Thursday 8th.
If you count 16/6 as day 1 of your notice then 13th July would be your last shift.

flowery · 04/07/2021 13:27

They are wrong. Notice starts the following day. www.citizensadvice.org.uk/work/leaving-a-job/dismissal/your-notice-period-during-dismissal/

AmIatotalthicko · 04/07/2021 17:24

@flowery, that's what I found when I googled. Mmmm. I think you and I are right Smile

If they don't want you at work on 12th & 13th they can always give you paid annual leave on those days. They can't just choose to terminate your employment sooner than the contractual notice period but they can tell you your actual services are not required (so long as they still pay you)

LIZS · 04/07/2021 17:35

They can pay you in lieu of notice.

AmIatotalthicko · 04/07/2021 17:40

@KihoBebiluPute I think they believe they are correct here and I think I am. Where does this leave us?
The problem is that this is a job in a private home and during my time there they have not stuck to their obligations as employers. I have been paid late, not provided with payslips, given virtually no notice of holiday etc. I could go on and on.

Show them the link and confirm you will bring a claim for unlawful deduction from wages if they do not pay you for 13 July as you are ready and willing to work that day and they did not give notice in time to terminate your employment any sooner.

They are not unreasonable for thinking they are correct- the fact many on this thread have assumed the same thing shows you that.

But they are incorrect, which hopefully they will acknowledge when they see the advice from CAB.

I cannot add to the advice flowery has given on the employment, legal and practical.

On a human level I would just observe that I think you probably need to set the history to one side and approach it with this in mind so that your frustration about the past doesn't seep into your interactions.

AmIatotalthicko · 04/07/2021 18:59

Thank you all. @user432543424532 I am nothing but professional to their faces. I am just frustrated today and sounding off, but I would never show this. I couldn't have stayed there so long if I was unable to do this as I have been tested to the absolute limit and have always forgiven, forgotten and got on with it. I suppose I just feel like they can't even get rid of me properly!
