Resigning 3 month after Maternity Leave.

Hi guys quick question. I've been back from maternity leave since March 2021. My DD is just over 1 years old. I'm wanting to leave work as I don't feel supported at work and I suffer from PTSD from my birth (which I receive psychiatrist help for) I work as a HCA for the NHS and the new information triggers my PTSD even more. I was off work twice one for my daughter being admitted into hospital with kidney infection and another for her dad not showing up for her so I had no childcare that day! For this I was given a verbal warning as in her words was "unacceptable and unreasonable excuses" and had to take unpaid leave not parental leave!

My manger isn't very approachable, never has been she isn't confidential either tells others your business. So I don't trust her or anyone else there. Does anyone know if I have to pay the whole Maternity Leave back (OMP) or just part. I have asked HR and they said to print off the policy but the system is down. I don't think I can last much longer in there without going insane.

You don't need to repay statutory maternity pay (ordinary or additional), only if you were getting additional contractual maternity pay on top. HR should have been able to answer that one pretty quickly!

Thanks for the reply so on my payslips I have (OMP PAY) and (SMP PAY)

You only need to do 3 months back at work for the NHS not to pay back any maternity pay so you should be fine

Hmmmm not sure about the acronyms. Perhaps check the gov.uk calculator to check the amount you have been getting and whether it tallies with the weekly rate.

*Statutory Maternity Pay (SMP) is paid for up to 39 weeks. You get:

90% of your average weekly earnings (before tax) for the first 6 weeks
£151.97or 90% of your average weekly earnings (whichever is lower) for the next 33 weeks
SMP is paid in the same way as your wages (for example monthly or weekly). Tax and National Insurance will be deducted.

Use the maternity pay calculator to work out how much you could get.*

NHS worker here. Once you've been back for 3 months you don't have to pay back your maternity pay. Best of luck for the future

You have to be back for 13 weeks - any leas than that you have to pay back any extra pay (but not SMP)

I had similar with my first job, went back when DC was 9months to get it out of the way, did my 13 weeks and then buggered off as soon as I could!

I would especially be out of there if the manager was unapproachable and to be honest they don’t sound like they are going to be understanding so I would leave and make your reasons clear when you do.
