Term time contract.

I have had a term time contract since April.
However, cutbacks are being made at work (job cuts). My manager has called a meeting with all staff who have term time contracts, the HR person and the union rep. The meeting is not until the week before Xmas. I am worried that we are to be told that we have to go on normal contracts (which will probably mean I will have to give up work).

Can they do this (revoke a term time contract once given?)

First point to make is that if they are trying to save money I would be surprised if they want to move you all on to normal contracts as presumably that would mean more hours.

However to answer the question about whether they can amend your contract or not, the short answer is that the basic principle is no, you have to agree it. The long answer is it's a bit more complicated than that, and as long as there is a good business reason why they need to do it and they are prepared to jump through several hoops, they probably can do it.

See here about changing terms and conditions and here about what happens if you don't agree. As you can see, if they are confident there is a good business reason to do it, and willing to risk that you won't bring a difficult-to-win unfair dismissal case, they can do it if they need to.

Although the principle of not changing contracts without consent of both parties is there and is a good one, I'm sure you will appreciate that there are times when an employer simply has to alter terms and conditions, has no choice, and there has to therefore be a mechanism whereby they can do that.

Read the links I have sent you so you are fully informed and go to the meeting and see what happens. Do you have any particular reason to think they want to put you on a normal contract - have you had any other indications that this is what they want? If you have a union rep going to the meeting try and relax a bit - hopefully he/she knows his/her stuff.

I have worked for the organisation (NHS TRust) for 7 yrs. We have always had staff on term time contracts but there were enough staff to cover. Recently there have been so many cuts that there are fewer staff to cover the holiday periods.There has been an increase in staff with children (who all want AL in school holidays as well) and an increase in staff asking for term time contracts (recently some have been refused).

I can see why term time contracts are a problem. In my area it works fine, but would work less well in other areas.

I have a feeling that they will try to scrap everyones to be fair rather than agree to some and not others.

See what happens at the meeting - you now know at least what will happen should they propose a change to your contract that you do not agree to. If the current arrangement works fine in your area that may help you.

i asked my farmer manager for a changed of my working condition so that i can do permanent night, becase i have a child. She said i need to write to HR. I wrote the letter which was given to my manager, it was not respond to, but they let me do night untill now. now my present manager want to change be back to day. i still have to take my child to and from schol. can she change my contract without me. even it see like my farmer manager did not do anything with the latter i give put i guest put it in the bin
