I filed a grievance against the person who'd put me on one and then proceeded to make sure I passed it.

That’s a lot of stress to get through if 6 months’ pay and an agreed reference is the alternative. Depends on current jobs situation in the relevant industry though

@eurotrashed 6 months' pay is exceptional. Most people put on capability won't get that.

Let's not set unrealistic expectations.

If someone is put on a capability procedure, it's because their manager has concerns that they cannot do the job they were employed to do.

If the employee believes that's unfair, then they can raise a grievance, but let's be clear if the manager wants to continue down that route, then they will press on and not even consider any payoff, why should they.

If the reason for capability problems is due to a protected characteristic, which the employer has existing awareness about, then in this scenario it could be a negotiated exit, or the employee could take the employer to Tribunal but not until they've exhausted all internal procedures first.

So it isn't just a question of getting a payment and heading off into the sunset.

Current jobs and industries have little to do with employment law and internal corporate HR policies in this context.
