Flexible working rejected

Sheeba1986 · 25/05/2021 18:52

Hi

I applied for flexible working for my return on the 1st July. It has been rejected but I am going to appeal

Can someone point me in the right direction to help me write it out?

What are you asking for and have you had any reason that it was rejected? You need to focus on the business need and how you will make that work and how it could be beneficial as opposed to personal reasons

Sheeba1986 · 25/05/2021 19:23

I have asked to drop one day and do set shifts

And how did you ohrase your argument that it wil help the business? What was their reason for rejecting?

omgthepain · 25/05/2021 19:26

I'd contact ACAS I think

andivfmakes3 · 25/05/2021 19:26

You need to provide a valid argument? What was yours? Just being a parent doesn't cut it I'm afraid

nevernotstruggling · 25/05/2021 19:28

That's so sad I've always had flexi in my industry (civil servant).
Are out in a union?

Sheeba1986 · 25/05/2021 19:29

I'm well aware being a parent doesn't just cut it! Im a manager myself so i know how it works. I was asking if there was anyone that could help me write an appeal letter. I've spoken to ACAS also

Why did they turn you down? Do others have it in your workplace?

They will say that your new hours don’t meet the needs of the business. It’s a very difficult one to win.

randomkey123 · 25/05/2021 19:31

What makes you think that an appeal is going to work when they've already considered it and said no?

andivfmakes3 · 25/05/2021 19:37

So what are the grounds you are requesting it on then!? No one here can help you if we don't know the details?!

FrancesFlute · 25/05/2021 19:39

Noone can offer you advice on what to write if you don't give the details of why it was rejected Smile

AppleDumplin · 25/05/2021 19:46

Look at the 8 statutory reasons (at least one of which must be used to reject a FW request) and make sure your appeal sets out why none of them apply in your case.

AppleDumplin · 25/05/2021 19:47

Forgot to say- HR manager here who deals with a lot of FW applications!

nevernotstruggling · 25/05/2021 21:44

See if you can find out if they have granted it to a like for like post anywhere else within the company. One of my friends is a branch manager and found out a neighbouring branch manager had a flexi day once a fortnight. Company had already rejected my friend but had to back down when she could evidence they had agreed elsewhere

flowery · 25/05/2021 23:39

What reason/s were you given for rejection? Your appeal should be based on those.

A similar flexible working request granted previously doesn’t set a precedent- each request should be considered individually on its own merits.

Not always but a precedent is exactly that.
flowery · 26/05/2021 07:34

A precedent is exactly what?

The only issue with a previous similar request having been granted is that the employee may be able to use it as evidence that the reasons being given for rejection aren’t actually the case. But the mere fact of other requests having been granted in the past absolutely does not set a precedent that future similar ones have to also be granted.

I am sure there are people that can help. But only if you set out what you were asking for in a bit more detail and the reason for the refusal.
altforvarmt · 26/05/2021 11:55

Yes, it would be useful if you outline what you proposed could happen with 20% of your workload. And their reasons for rejecting your request.

There was likely other reasons. Just because someone else has something doesn't mean everyone else is entitled. It would be a nightmare otherwise.

Jane, Sue and Rita all work full time in in same department. Rita changes her hours and does 18.75 hours a week between Monday and Wednesday. Sue and Jane then decide they want the same hours. They can't because there would be no cover. The very fact that Rita has flexible working in place means that they can't.

Everleigh2021 · 27/05/2021 22:16

I’m thinking it’s the set shifts which are an issue

What shifts did you ask for?

Furbs · 27/05/2021 22:18

I wrote an appeal letter that was upheld. I'm in bed now but happy to look for it in the morning and send you it once I've taken out employers details so you can see if you could edit it to your own situation?
