NHS Maternity pay

Hi, I'm looking into the maternity pay from the NHS and it looks like im 1 day off the better pay. my start date on my contract was the 22 june 2020. my due date is 12th sept. after reading this qoute :

An employee working full-time or part-time will be entitled to paid and unpaid maternity leave under the NHS contractual maternity pay scheme if:
i) she has 12 months’ continuous service (see paragraphs 15.60 to 15.64) with one or more NHS employers at the beginning of the 11th week before the expected week of childbirth

I will be 1 day off meeting the requirements. this is because the 22nd in 2020 was a monday and the 11 weeks before a year in 2021 will be a tuesday. will this still count as the 11 weeks before?

thanks.

Hi @Wrigg I'm in the same predicament and wondering the same - did you ever speak to your HR about this?

Hi there,

I know this is an old post but I am in same predicament! Going by what it says on the website I’m 12 days out of working for the nhs for 12 month and 11 weeks before baby is born. Im gutted if I can’t get the NHS maternity pay😞

Hey I know this is an old post but wondered what the outcome was @Wrigg, I am the same with you with the start date in 2021 being a Monday but that falls to a Tuesday this year to be the 1 year anniversary for continuous employment. Best wishes 😀

Wrigg · 05/05/2022 12:29

it took some messages back and forth but eventually they gave the full pay. they were unsure them selves. saying no at first then eventully getting a yes. if you get a no at first keep trying. goodluck.

@Wrigg thanks so much for coming back to me! Glad you had a positive outcome with the pay!

I have found an FAQ sheet on the NHS business unit page which re. ‘What is my entitlement for maternity leave’ just says;

’Providing you have at least 12 months continuous service (counting back 11 weeks before your due date) and intend to work for the NHS for at least 3 months after your leave ends you are entitled to occupational maternity pay’

So I’ve saved a copy of this as well as this doesn’t use the wording about the ‘beginning of the week’.

Will await the outcome!
