UK statutory entitlement 5.6 weeks.

Can some of this be carried over or does it all have to be taken in one year? Can some of it be bought back by the employer?

You’d need to check your employers policies. Where I work it can’t be rolled over and they don’t buy holiday back, though we can buy extra. Where my husband works up to 10 days can be carried forward into the next years allowance.

my work gives us 35 days holiday so more that statutory (inc bank holidays) and we can buy 5 more or sell 5 back but this is decided in the November for the following year
depends on which department you are in depends if you can carry over - but only a max of 5 days

Some employers use discretion to carry over any unused leave , up to say 3 or 5 days with manager's approval, but allowing an employee to carry over any is only a legal requirement in certain circumstances ie maternity leave or long term sick leave. The handbook should specify any discretionary policy.

@dementedpixie That's really helpful - we changed our holiday period start date and offered the choice of buying back days or carrying days over - I wanted to give them all the options but have forgotten to account for the legal minimum ...I'll crunch the numbers.

Unless there are justifiable reasons e.g long term sick, the four weeks regulation 13 leave must be taken in the leave year, bank holidays count towards the four weeks. Nothing must be done to stop an employee taking this leave e.g. you can’t pay in lieu.

The 1.6 weeks regulation 13A has a bit more flexibility.

Contractual leave you can do what you want within reason and contract permitting.

Thanks - just checked the numbers and it's all good - they have taken the statutory minimum already...so no need to impose further restrictions on them - the contract can always be amended with their agreement.

That’s good so it’s really just up to employees what they would prefer.
