Can a colleague breach your data/information?

Hi

A colleague has a bee in her bonnet about the amount of over time others are doing. She does not hold any management responsibilities. She has taken it up on herself to pin up a table with all colleagues names on and keep a tally on how many additional hours anybody works. This is visible in a break out space accessed by a high number of staff - some appear on the table and some don't.

Apart from being highly annoying - I want to know is this a misuse of my information under GDPR?

That's ridiculous and pointless. Extra hours are that - extra. If people aren't contracted to them they aren't essential and people shouldn't be penalised for it because she has a bee in her bonnet

Probably not, if it is information you all have access to anyway. She is not prevented from rearranging available data into a table.

It does sound divisive though.

I don't think it's a GDPR breach but it is petty, odd behaviour and her manager should be talking to her about why she feels it is necessary!

Thank you for the replies. I think she feels that if others are getting paid overtime its depriving her - but everybody gets the same offer - its just whether you take the offered OT or not! As you say strange.

The overtime info is not available data as such only if another person is keeping tabs (apart from payroll of course).

I feel really uncomfortable with my name in a public place, without my permission with personal information on.

Just tell her to either take it down or take your name off, its none of her business. If she doesnt then take it down yourself, every time.

Go in before her and take it down. Report it to management. She clearly has issues if she is that upset by it.

Yes, it is a gdpr issue as she is recording data, processing it and publishing, and she has no right given by the company.

I wouldn't ask her anything, o would simply email your manager to say you don't think this is appropriate and you don't want your name included.

Don't get into anything complicated first off.

I raised a similar issue about leave on a shared sheet as for one staff member it said 'sickness' meaning I could count their days. HR agreed and everyone's just says 'leave' now.

If I were her supervisor it would put the thought into my head that if she was monitoring what her colleagues are doing so closely her mind wouldn't be fully on her own work. In your position I would object to it and ask that I be removed from her display.
Do you know what problem she has with others working the overtime?

She is not prevented from rearranging available data into a table.

She is not entitled to process this data without company permission, and all processing must accord with the privacy notices.

If she is not a data controller or a data processor within GDPR obligations she is doing the wrong thing.

I doubt any company will say 'any random employee can process colleagues' data for any reason and pin up' though, as that would be non-compliant.

Just speak to your manager and tell them there's something weird going on with your colleague and you don't think it's anyone's business to have this info on show.

We used to have a busybody like her in our team. Fortunately our HOD had the measure of her and would pull her up on it every time she thought something that was her busiess actually wasn't.

She was furloughed at the start of lockdown last year, then made redundant.

As everyone else has already suggested, you need to raise this with your manager.

Thank you. I've removed my name and spoken to her directly stating that I don't want to be included. The table is still up. If she puts my name back on I will go don't the line management gdpr route.thanks for the advice and input - I don't know what is wrong with people.

I would be concerned about the effect something like this is having on the culture within the work place - I'm assuming it's not positive as a consequence - she should be asked to remove it immediately - she might even need a bit of training on how her behaviour was having a negative effect on others.

Update - its been taken down and moved to her locker! 🤷‍♀️Yes it's causing ill feeling - watch this space. These things have a way of working themselves out i guess!

I think when things are very odd - as this is - multiple people complain so they get resolved quite quickly.

Hopefully managers will knock it on the head.
