Continuous service moving council to nhs

Hi, I wondered if anyone working in hr in the nhs, or anyone with personal experience of this could help answer my query please? I have over 10 years continuous service in a local council, if I took a similar role (non medical) in the nhs, could my continuous service count for annual leave, sick pay etc? Thanks in advance!

I have only worked in the private sector but surely they would surely be different employers?

I doubt it, they're completely different employers.

For example you wouldn't expect your length of service etc if you worked at Tesco to be recognised if you went to work at Screwfix just because they're both retailers?

It varies and generally in my experience the answer is no, but in certain cases (e.g. some public health roles) I have seen it done but unless it's a highly specialised PH or similar role I'd be surprised if they allowed it. Also it would only apply for things like annual leave entitlement and contractual benefits, legally it'd still be classed as a new employer.

@larrythelizard this is generally true but historically some roles have moved between councils and the NHS (E.g. public health) and it has been done in some cases, less so now I think, but certainly has happened before.

The only thing I could transfer when I changed employer was my pension. I’d worked 8 years in the first job and was given just under 5 for the new one.

I have recently started a new role in the NHS (healthcare though) and I was able to transfer my previous non-NHS experience to count towards annual leave. I think it would depend on the trust though, might be worth contacting the trust HR directly and asking.

It may in some circumstances be considered for annual leave, but unless you TUPE it won't be considered for redundancy/sick pay etc..

I changed from NHS to council with over 10 years service. Was told it would not transfer over. Absolutely gutted, had to start building all my holiday again.

You will need to ask the NHS HR department if they will recognise the local government service. Different Trusts will have their own policies.
I am NHS and we will recognise local government service in like for like roles yet we do not recognise service in GP Practices.
That seems unfair to me but it does come down to Trust policy.

@loadypoady that’s incorrect and goes against nhs guidance. All nhs employment is recognised no matter what. The only time a gp practice wouldn’t be is if you worked for the private company running a practice.
