Is this proof of right to work in the UK?

  1. A full birth certificate
  2. A recent payslip with the national insurance number on.

Wanting to employ someone in my home but they do not have a passport or driving license.

I am sure it is, if you don't have a passport birth certificate and NI number in an official document are fine if they are a UK national Obviously if they are not they would also need proof of right to work or right to remain

It's also best to require proof of address. As a rule I'd follow the rules of the proof required for a dbs check, as that would provide a double check as obviously the onus is on you ensuring it's accurate.

Even if I know she is from the UK, I still have to check documents.
It's a legal requirement when hiring someone.

I didn’t have passport or driving licence. An expired passport was acceptable.

No it isn’t. Being born in a country does not mean you are a citizen or even resident of that country.

Because being born here does not confer British nationality - that comes from your parents, and theirbstatus at the time of your birth. That is why birth certificate is not normally taken as proof

Yes @MiaMarshmallows a full UK birth certificate and proof on NI is acceptable.

A full UK birth certificate plus NI number certainly indicates that they may have the right to work but it does not prove right to work.

Anybody born in the UK will get a UK issued birth certificate, whether that confers citizenship or residency depends on their parents nationality and their status in the UK at the time of birth. For example somebody born here whilst they non British parents are on holiday does not get citizenship or residency.

An NI number only indicate that at some point the person was eligible to work in the UK, however such eligibility can expire and they still have the NI number.

If a British citizen produces their birth certificate and a document from their previous employer or a government agency showing their name and NI number, this is all the evidence you, as an employer, need of their right to work. The information is on the government website. Look at www.gov.uk/legal-right-work-uk. If you click the start button and answer the questions it will tell you what documents the employer needs to see. In the OP's case, the answers she has given in this thread take you to the page I linked in my previous post.

You can’t force people to get a passport! They’re not compulsory. What if they can’t afford one? I don’t have a passport. My expired passport was enough to prove eligibility to work. Anything that’s on that link just posted..”

Yes, as long as it’s a full birth certificate not the short one and accompanied by an official document from the government or a previous employer with their NI number on.

You cannot accept a driving licence anyway.

If you have seen those documents and made reasonable efforts to ensure they are genuine then you are covered.

You must make and retain a clear copy of them.
