Employer read my personal text messages

Posting on behalf of someone else to give them advice.
Person recently left their phone at work accidentally.
Someone read all of their messages and now they've been suspended as they were talking about other staff members with another staff member.

I don't think the employers should have read the messages it's not a work phone but someone else did have the password for some reason (guessing friendly colleague) 🤷🏼‍♀️
Where do they stand legally, Are employers allowed to do this?

I think they're wrong on all sorts of levels. I'm furious for these people involved.

Are they just looking for an excuse to get rid of your friend. They may try and turn it round and say mobiles are not allowed at work or that texting anout colleagues is bullying but the other person should also be suspenfed if they joined in the texts. Do you think the person who unlicked it a d showef the messages to the manager is just shit stirring and knew what was on there.

Very possibly. It wasn't the person with the code who read them. Seems this person who was written about has been causing issue last so has probably run to management about it.
Solicitors are involved now anyway

Well if it wasn't the person with the code who read the messages, how did they get access to them? I don't know if you genuinely don't know all the details here or if you are being fed a story by your friend but I don't think people can offer much useful advice with so many unknowns.

I don't know all the details I've asked a few questions but don't want interrogate them as if I've got answers to give. From what I can gather though the device was updating and wasn't locked 🤷🏼‍♀️ I could be wrong there though.
