Unpaid leave

My younger sister unfortunately used her sick leave up at work at start of year after breaking her arm in a car crash.
If she takes sick leave she will get Ssp but that is not the issue , she is very frugal and has saved enough to take two week unpaid leave .
She needs this as her daughters nursery have contacted her and two children are covid + , both have mild symptoms but it means time off work as she is a single mom.
Her problem is she is due to hand in her notice next week !

What’s your question?

Sarapq2 · 02/12/2020 17:19

Sorry if I hadn't made it clear

Can she take it as unpaid leave as she is not sick

She'd rather take it as unpaid as it won't go down as sickness , as although she has new job she waiting on health clearance .
Normally if her child unwell mom looks after her but moms unable due to covid risk

She can request it but they can refuse. But if she's resigning anyway she could just leave?

dementedpixie · 02/12/2020 17:54

She cant take sick leave as she isn't sick. It would be unpaid leave or annual leave she'd be using anyway

Sarapq2 · 02/12/2020 18:05

Thankyou , she thought about contacting gp
To be signed off as she suffered from depression after the accident ( she lost her boyfriend in the accident ) but I said that would be picked up by the new icy health team and although she gets a bit down it's not like before.
It seems daft to have to put herself as sick and risk her new job .

Can she not just tell her employer she needs to be off as her child is isolating and noone else can do it?

tinierclanger · 02/12/2020 18:53

I would have thought that would come under dependants leave? Or she could take it as parental leave.

Orangesandlemons82 · 02/12/2020 18:58

Are the children covid positive? If they are isn't she meant to be self isolating anyway?

Orangesandlemons82 · 02/12/2020 18:59

Sorry just reread. It's not her children. I clearly can't read.

dementedpixie · 02/12/2020 19:00

She cant take parental leave without advance notice

I took it that 2 children at the nursery are positive so her child needs to isolate for 2 weeks

Sarapq2 · 02/12/2020 19:03

She gets some universal credit so can't just resign she will need a confirmed start date.
Yes they are positive and she will be isolating
But she doesn't want it going down as sickness as it may put new job at risk her occy health appointment is Tuesday

So her own kids are positive?

Its not sick leave though as its her kids that are sick, not her. She can still claim SSP if she is off due to her kids testing positive. It doesn't go down as sick leave though. Can she not talk to her employer?

dementedpixie · 02/12/2020 19:08

Whose kids are positive? Can you clarify?
Regardless, the leave she takes is not sick leave

RedDiamond · 02/12/2020 19:11

When did the children become positive? How long ago? She cannot go to an occupational health meeting if she is isolating with the children.

tinierclanger · 02/12/2020 19:13

Well, she can't take it as sick anyway as she's not sick. Pretty sure it's covered by dependents leave though

dementedpixie · 02/12/2020 19:33

Time off for dependants covers short emergency periods of childcare, not 2 weeks off
