Part time KIT days

Trying to work out what I should be paid...

I work part time, 0.6 over 3 days. I work 3 full days rather than the full time 5.

I’ve asked HR how my pay is worked out for KIT days. For full timers they do basic salary/261 x number of days. They’re proposing that for me they would do my basic salary/261 x number of days. I work 156 days per year, so I’d be receiving 60% of a days pay.

This doesn’t feel right to me, surely I should get a full day of pay? It would make more sense to me that I would get 6 KIT days paid in full, but perhaps the legislation doesn’t allow for that.

Not sure of the legislation but I don’t see why you don’t just get 6 days at full pay. You should ask them why not.

I think the legislation is that it has to be agreed between you and your employer before you do then? www.gov.uk/employee-rights-when-on-leave
My organisations Maternity policy has details on what I get paid as it depends whether I take them during my enhanced period, my statutory pay period or the unpaid weeks at the end. So maybe check the policy? For what it’s worth I only work 4 days a week and can choose to do up to 10 days (doesn’t matter how many days you work as I was still entitled to 10 with my first pregnancy when I worked 5 days a week). I get full pay during my unpaid period and then less stat pay during that period and nothing if I take them during my enhanced period when I get full pay anyway.

Yes, mine is the same so it’s not worth me taking any KIT days until my pay drops. Employer’s policy is that all women on mat leave are entitled to 10 days. I think I’ll just ensure I take all 10 days, do maximum 0.6 of a day on them and get the 60% pay. I’m still not convinced that’s right, but it feels fair.

How much you get paid is between you and your employer. However as a part timer you shouldn’t get treated less favourably than a full timer, so if they normally pay a full day’s pay to full timers, they should for you too.

Obviously if you don’t work a full day that’s different.
