It's an annual leave one! Any HR experts?!

My leave year runs Jan-Dec. I started on 1st September so I will have worked four whole months in this leave year (i.e. exactly one third of the year)

My leave entitlement is 27 days plus bank holidays (of which there are eight).

So is my entitlement for this leave year, 9 days plus one third of eight? So a total of 11.6 days?

My work are saying I just have nine days, and seem to be forgetting about the bank holiday side of things. As there is only one more bank holiday left this calendar year then they are only giving me ten days instead of 11.6. Is this fair?

Bank holidays are usually already included in your pay so you I would think you wouldn’t get them as extra days leave?

Except if your part time - I don’t work Fridays so don’t get paid for Fridays any bank holidays that fall on a Friday I get the hours back as leave. This is because my contract says 20 days leave and bank holidays.

I completely and utterly disagree with you gurglebelly that makes no sense at all.
If you only work Mon & Fri that means you get a massively higher number of paid days off each year compared to someone working Weds/Thurs.
There is a heavy weighting of bank/public holidays in some months - Easter, May Day, Spring bank compared to sept/Oct/Nov when there aren't any at all - the only way for it to be fair is to pro-rare it and include public holidays within the paid leave entitlement.

And I say this as someone with 20 years HR experience.

Also think about it from a maternity leave perspective - you still accrue paid leave for bank holidays just the same as your other entitlement.
Also, the working time directive says 5.6 weeks paid leave per year including public holidays.

You get bank holidays while on maternity leave as you were employed when the bank holidays fell. Same for part time workers.

Not employed by the business when they happened (like in this case) no entitlement. That simple.

I changed employers a couple of years ago at a similar time, I got proportionate leave for the remainder of the year and the Christmas day and Boxing Day bank Holidays. So I think you're only entitled to any bank holidays that have yet to occur

I think both annual leave and bank holidays should be pro rata, so if you worked 33% of the year you are entitled to 33% of bank holidays.
I believe you are only entitled to the bank holidays that occur when you are employed.
