Redundancy HELP

alexis4theppl · 19/10/2020 22:17

I have been working for my employer for almost 15years in various roles/companies. After returning from Mat leave the job I left was gone, the place of work was changed and I moved to similar role in a different office. Covid hit, worked from home but struggled with small child at home. I was then furloughed but have recently been told I will be made redundant.

I have agreed with the redundancy and expected statutory redundancy for the 15 years service. I don't have a contract. I have received an email today to say il receive statutory redundancy pay equivalent to 6 weeks pay.

Wtf... how can they offer me this? What do I do? I have emailed back asking if this is a mistake but not had a reply yet. Planning to call tomorrow but would appreciate any advice on this.

Thanks

You will need to prove you have been employed by the same company for the 15 yrs. if you don’t have a contact (whole separate issue) then have you got p60’s?

I have been employed by the same people for 15years, under 2companies during this time. No I haven't ever been provided with a p60, I have payslips.

If you were employed by two different companies, even if run by the same people, then unless you were TUPE transferred between them, you probably won’t be able to claim you have 15 years service, even with the payslips.
I would suggest you give Acas a call for further guidance and see what they say

Ok thanks for your advice

Not correct. Continuous employment needs to be either with one employer or with one or more associated employers. An associated employer would either be an owner or a subsidiary, or another company owned or controlled by the same person/people.

It sounds as though the companies are associated employers therefore the whole 15 years counts.

Wow thanks @flowery that's brilliant to know. My situation is exactly that. Those companies are still operation and owned by those same employers.
