Wrong hours on work contract

Hoping someone from a HR background here. I’ve been in my current job for 18 months working 25 hrs a week. My salary is pro rota based on a 40 hr week. New girl starts (inexperience 20 year old) been paid the same basic salary as I am but her contact is 40 hours a week as she is full time. Well the HR manager has screwed up in the her contract, she’s been paid for 40 hrs a week but her working hours only equate to 36 per week.My main annoyance is that A)she’s been paid for 16 hours a month she doesn’t work B) she’s lazy and doesn’t pull her weight. I’ve raised this 2 weeks ago with the COO, he’s investigated it and realises the HR person who drew up her contract hasn’t realised she only works 36 hours and not the 40 states on the contract. Where do I stand with this? Can they amend her contract to pay her less or increase mine? They have said we should be earning the same rate. They are slow in getting anything sorted but I feel so irritated I do most the work whilst she sits playing on social media on her phones whilst been paid for hours she doesn’t work! How does a HR manager make such a huge mistake!

Why doesn’t she just have the extra four hours added to her work pattern over the course of the week?

These are all separate issues. Your contract has nothing to do with hers. If your contract is correct for what was agreed with you, then what her contract say is irrelevant to you. Any dissatisfaction with her work needs to go through the appropriate channels, so raise with your manager. Hopefully you are an exemplary person employee so she won’t have anything to retaliate about!

HR people are human. And generally acting on the instructions of others.

As one, I can tell you that you have no rights over anything related to her pay. Only your own.

Your employer could decide to:

Issue a correct contract, correct her salary and recover the overpayment from her. They would have to act quickly.

Issue a correct contract, adjust her salary accordingly and write off the overpayment.

Require her to work 40 hours per week as per the contract. No change to salary. Could recover overpayment if worth their while doing so.

Adjust your salary.

Not change your arrangements at all.

The HR person was advised to copy my contract so they were the same. She cocked up as she never realised the hours she was given to enter on the contract didn't add up to 40 hours a week. They are not the sort of company to pay more than they have too

Her salary and hours are none of your business
If she isn’t doing her work address this with her manager

I understand they had to copy your contract but why did that mean you get to see hers? That's a breach of privacy.

She told me her contract is 40 hours per week but it’s not rocket science when her start and finish times don’t add up to 40 hours. Her manager forgot to tell the HR person drawing up the contract she wasn’t working the standard full time hours.

Her working hours don't affect your hours or pay at all OP - you seem to be pretty annoyed that she is paid the same as you, but that's up to the company. Equally, if she has been overpaid then it is also up to the company what they do (if anything) about that.
