Losing AL after 5 years service - advice please

I'm returning to work after maternity and have amended my working pattern.
I've worked long enough to have an additional 5 days AL due to me effective early this year, but now that I'm returning to work and reducing my hours, my employer is putting me back to my original lower AL entitlement, minus the additional long service days.

I'm obviously not getting my full AL entitlement anyway on reduced hours, but I expected my reduced entitlement to be calculated from my full long service entitlement, not putting me back to scratch and wiping that 5 years worth of extra days 😟

Does anyone here know if what they're doing is correct? Maybe I've just assumed wrongly, but keen to check before i challenege it.

My new contract has a start date for the new terms and a note of my original continuous employment start date from many years ago.

Any advice would be appreciated. Thanks

I don't think this sounds right. Have you asked them why? I'm guessing it's an error.

I'm hoping that it is, i just want to know where I stand before I challenge them as they've been a bit of a nightmare with my holiday entitlement throughout. So it's possible they have messed up, but also possible theyre trying to rob me of some days in the hope I dont notice 🤷‍♀️

Is it down to salary? Certain salaries in my company come with more annual leave days ect?

Have you checked your terms and conditions.
Going part timw in the same role shouldnt make a difference to entitlement just as you say need to pro rata for the lower hours

All you can do is tell them your annual leave entitlement increased on X date and they need to include this in their calculations.

If they say no, take it from there.

I went from full time to part time after may leave. I accumulated an extra 5 days leave from length of service. I still get this but it’s pro rata instead.

Doesn’t sound right. Your original start date has not changed, regardless of maternity leave. You’ve still been with the company all the time. Definitely get that checked.

They need to pro-rate your full time annual leave entitlement for the year upto the point you returned from maternity, then calculate the remaining months of the year at your reduced hours.
For example, if you returned in August, you're entitled to 8 months full time holiday entitlement plus 4 months at your new hours entitlement - if you returned on 30 hours per week, this would be calculated as full time annual hours x 0.8 (which would give you your annual pro rate entitlement) / 12 * number of months you're working part time.

Hopefully that makes sense!

Thank you everyone. It was deliberate and they thought it was correct, but when i pointed out that it should be based on continuous employment they changed it! Thanks for the advice / support 👍
