Can I work in a second job if signed off sick from one?

I wouldn’t be working the same hours as in job no1. It would be weekends/evenings. Any advice?

If you resign you hand on your notice, usually this means you are still employed for between 1 week and 3 months.

It doesn't mean you're jobless

It's a second job because there are 2 jobs

You can resign whilst signed off sick.

When in your pg/ml does your notice period expire? Any Enhanced maternity pay scheme may be conditional on you not being under notice, if that is what you are holding out for.

Fraud. I have seen results from having to repay your sick pay to losing your job. And if you're a registered professional in a body like the GMC, NMC etc you could be further referred to them too.

Only that you seemed to imply it would penalise you financially to negotiate an earlier exit. If you are employed at 26th week, and have been there over 6 months, you still get smp but could apply for ma if not. Do you have any accrued leave?

It would penalise me financially because I would be going on maternity leave earlier than planned and thus run out of maternity pay earlier than planned.

Surely working any job will end the SMP though? You can't receive Statutory Maternity Pay and work at the same time.

In our employment contract it states that if you are off sick you are unable to work and as such, second job working is considered gross misconduct with immediate dismisall

The short answer is yes you can. Particularly if the two jobs are different.

I.e. you could be signed off as a builder, but still able to work as a typist.
