I was made redundant at the beginning of August, and managed to get a new job. It's £25,000 a yr working in hospitality. Last few weeks my hours have been over 48 hours to the point I've worked 18 hours already over my 48 hr contracted / agreed hours in 3 weeks - none of which are recorded by anyone but me. This means that next week when my hours are 56+ hours I'm actually working for less than minimum wage.
I'm at the end of my tether with this. I can't keep working like a nutter on the trust that I will get more time off in the winter - I'm finding life v difficult already with the hours I'm working. There are no jobs around here at the moment.
I don't want to leave but what do I do?

Have you spoken to your manager or any coworkers about this? Why aren't you not getting paid for overtime?

Yes I've spoken to my manager and the owner. I'm on a salary so they're saying I will get paid the same if in the future I do less hours per week, take it or leave it - that's the way it is etc

Hmm.... where are the guarantees of this? Does it state that you will get back time owing in your contact? Has your employer acknowledged the extra time you have worked and confirmed you can have them back as lieu another time?

No - I have my own hours worked written down but nothing at work officially. It's all just down to trust. I cant work the 56 hours they have put me down to do next week physically it's too much for me - I don't want time off in lieu, but if I go on to hourly it will be basically a zero hours contract no guarantee of income.

Do you need to complete timesheets?

If you are being paid a salary yet working over and above those hours regularly, you need to as your manager/HR how you can recoup the time worked.

I think ACAS is your friend for now.

Also have you opted out of the working time directive? Might be worth getting familiar with it and, as a previous poster mentioned, acas www.gov.uk/maximum-weekly-working-hours

I'm assuming your OP contains a typo and that you are contracted t work 38 hours a week, not 48?

You then say you have worked an extra 18 hours in the past three weeks so an extra six hours per week, or approximately an extra one hour 12 mins per day?

Is this correct?

You know deep in your heart that these people are just piss takers. Any reputable boss, if you told them this would either be concerned and adjust if they could, take some if your workload, or pay you for your extra hours. In an ideal world.
Most don't.
So you just continue working for free.
Please. Do yourself a favour. Just don't. And look for another job in the meantime.

When you say you've been 'put down' for 56 hours next week, is that in writing?

Are you paid on a weekly or monthly basis?

If that's right, I don't think that's unreasonable. Most salaried (rather than waged) jobs expect a certain amount of overtime "for free".

However "putting you down for 56 hours" in one week isn't.

Do you have an HR function, or union?

What hours do your colleagues work? And can you check with them whether the promised slack time will actually materialise at some point?

Hi. No not a typo my contracted hours are 48 per week and I haven't signed an opt out. I'm recording my hours and so far (in 3 weeks) I have worked 18 hours over the 48 in total. I am paid monthly.
I was shown the rota last night (back of a fag packet kind of thing up on the wall) which has me down for 56+ hours next week. No HR as a small independent business. My colleague is also my boss and has said that I will work less hours over the winter but this is just a verbal / casual statement and my extra hours are not recorded except for by me. He's also quite rude whenever I bring up the fact that I asked for 40 hours max due to family commitments. Thanks for the advice everyone but I think I am going to leave and take my chances elsewhere as working for less than minimum wage per hour is just a piss take

Hmm No HR, small independent business a d the fact that they initially seemed fine with you just doing 40hours would make me run for the hills.

Working in hospitality (I'm assuming as some kind of manager as you'rr salaried), I would be surprised if you ever get the time 'back'. Being rotad on for 56 hours when your contracted are 48 without any prior discussion isn't ok. You've raised it, they haven't changed their practices so yes, I would move on if I were you.

Hi. Yes I have moved on but it's a real shame it had to come to that as they seemed really nice. Last straw was they took on another person p/t but paid them £10 an hour and then said he would take over my job in a few weeks so I would have less hours like I wanted! This would mean me working the long hours for less than minimum wage while he worked out his notice at his other job then me going down to 20-25 hours a week and going onto a zero hours contract. I was prepared to work 48 hours just no more than that. I was told that I would not get the time back I had done over the 48 hours after all that so basically I had no choice but to leave
