Age 41 and over redundancy pay

Hi,

Me again 😊I think this is my 3rd post but there have been a series of blunders and I do not trust my company.

I am at risk of redundancy and will be starting my notice paid in lieu this Friday - notice paid is 12 weeks.

I am going to be 42 in July. Internet tells me statutory pay is 1.5 weeks if you are over 41 - do I qualify for this if I am still officially serving notice when I reach 42?

There isn't enough information in your question to give a simple answer. It depends on the exact date on which you joined the business.

The fact they are paying you PILON means your employment finishes on Friday. You are not officially serving notice after that. However, when calculating redundancy pay we have to add on statutory notice. This is 2 weeks after 2 years service and an additional week for every year after that up to a maximum of 12 weeks. That determines your length of service for calculating redundancy pay.

The 1.5 weeks per year only applies to every full year of service since your 41st birthday. Years before that are paid at a lower rate. So at most you will qualify for one year at 1.5 weeks.
