Furlough Pay

Evening all,
I was furloughed mid April and the letter stated on full pay. When I had the conversation my boss made it clear that he only had approval for full pay for April and May.
Its now June, and I am waiting for a conversation from my boss about being unfurloughed which was meant to happen last week and has drifted (I now have childcare and from what everyone is saying that really need me back).
I know my boss, and know its best not to chase him, but my question is, though the letter stated full pay could they only pay me the government cap without my agreement?
Further issue is that my letter went to my work email which is now turned off...
Any advice would be greatly appreciated

They don’t need your agreement, it’s a bonus that many don’t get and they don’t need to consult you on it, although it would be polite to do so. Can you phone them and ask what’s going on?

I think it will depend on what exactly it said in the letter which as you can't access it doesn't help!

Being furloughed is a change to your contract and as such you need to agree to it. (Though if you refuse, you'd likely be made redundant so it's not much of a choice). Anyway you agreed to be furloughed on the terms as set out in the letter. So it depends if (for example) the letter said they would only top up your pay for those two months, or if it was more open ended.

I suppose the employer could argue that the verbal reference to April and May on the phone also formed part of the agreement but they might struggle to prove it if it's not in writing.

If I were you though I'd think carefully before making a fuss about this if they do only pay you the government cap from June... I wouldn't want to be seen as a difficult employee at the moment if redundancies might be on the cards.

Thanks. The letter clearly states full pay, and doesn’t have any timings to both being furloughed and that the pay is limited. For those not receiving a top up it clearly states their drop in salary on the letter (I had to do a couple myself before being furloughed)

Reality is, if it is on the £2500 I would prefer to be made redundant as it’s a huge drop in salary. And I’ve been headhunted for another role.

With regards to how I play it, That’s a separate issue (and hugely political). Ideally I’d just like to know where I stand legally. I actually doubt I’ll use it, but it’s always good to know.

I’ll get HR to send on the letter

My employer told me I would be getting 100% pay in May, I only got 80% in the end. I am NOT going to challenge as people are about to be made redundant!
