I've been on furlough for 7 weeks. My employer informed me I am being taken off furlough and will be returning to work. I can't work full time due to lack of childcare. They have now told me not to return to work. What do I do??

When they say not return to work what do they mean? Do they propose to pay you? Are they sacking you? How long have you worked there?

No I was to return part time, 2 days, then I got an email saying don't do that and we will contact you. No mention of pay and I dont think they would pay me anyway. Been there 4 years

Op, people can’t guess what they mean. You need to ask them for clarification not strangers on here .

Simply respond and ask if you’re still furloughed and if you will continue to get paid.

I didn't think they could put someone who is furloughed in work part time yet? Did they get mixed messages and think they could. I think you can from August. Realistically only they can answer your questions though.

That doesn't sound at all like they mean dont return ever plus they couldn't do that as you have over 2 years service. Sounds like they are having a rethink on what to do. Just ask them.

I'm waiting for them to get back to me. I can't return full time due to childcare, no school, not able to ask family to help, they then said they have taken me off furlough and would accept part time. Then they said don't come in and they will contact me.

Just email them and ask for clarification.

"Hi boss, just following up on our last conversation- am I correct in understanding that I am remaining on furlough until you call back and confirm my return to work date? Regards, OP"

As far as I am aware your employer needs your consent to end furlough and they need to give you a notice period. I believe the notice period is 3-4 weeks notice. If they did not specify a date in your contract variation furlough ends at the end of the scheme. This note is based on the most recent information I have seen.

There is no such notice period, or consent needed to bring someone back to work, no idea where that has come from at all.

That would only be the case if that provision had been specifically stated in the furlough agreement.

Ordinarily the contractual agreement to furlough would contain details of how/when furlough ends, either with a date, subject to review, or with details of other circumstances that would end it, or just 'when we say so'.

Obviously if someone is unable to work because of childcare or shielding, rather than because there is no work available, there would need to be 'reasonable' notice, which would usually mean a discussion about alternatives, such as annual leave or unpaid leave.

But there is no such thing as a specific requirement to get consent to bring someone back or to give that length of notice. Not at all.

Most I saw allowed for it to be brought to an end

A lot of people do not have this information in there agreement. Mine has no information in it whatsoever Hmm

They don't need to give you 3-4 weeks notice. They could give a discretionary week or so but that's incorrect.

This is why a lot of people are having problems. If people asked for the detail mentioned before agreeing to be furloughed, things would be easier. I appreciate a lot of people panicked though.
