Department store & furlough

My dd worked part time at a department store on a rolling contract since August.

On Saturday they told her they were terminating her contract. It’s was only a rolling contract so we weren’t surprised. They then said they would be back in touch as soon as the store reopens to re-hire her.

Yesterday she received an email from them saying all staff have been furloughed.

She said it doesn’t apply to her as she was let go, only on a temp contract, but I think that isn’t clear from the email. She said she only received the email as she is being paid up to end March...

Thoughts please?

Tell her to contact them and ask to be furloughed too. She will then get the 80% pay from the government and they can reinstate her contract when this has passed. Martin Lewis (money saving expert) spoke today about this so worth a google. HTH.

Please please don’t pay any attention to Martin Lewis on this- he’s been spouting a load of inaccurate nonsense causing HR people up and down the country a giant headache as people who are not entitled to be furloughed start demanding it on his say-so.

OP what do you mean by a “rolling contract”? There’s not really any such thing.

Anyway, she needs to ask her employer. They could terminate her employment or they could place her on furlough, but they are not obliged to do that.

The government has set this up to enable workers to be paid a reduced income of 80% where otherwise they would have lost their job. The employer would have no reason not to furlough her, as they are with other staff, and provide her an income especially if they intend to employee them again.

Please don't be put off in asking.

Yes I know all that. I didn’t say she shouldn’t ask. I just advised people not to listen to Martin Lewis on employment law. Confused

Thank you all for your response, it’s seems like it’s worth the call. She’s saying it isn’t as they told her F2f she had finished.

It’s her first job so first experiences.

Rolling contract, I meant monthly contract, they have just been renewing each month or two and she resigns. Current contract was to end April before it was terminated.

Martin Lewis has been winding me up all week too. He thinks he's doing people a favour, on some sort of mission to save people from the dole queue, but it gives people false hope and means I've had people in tears when I've said they may not be eligible.
