Working under duress?

I've worked at my company for 7,1/2 years. Over the last few months, they have made 1 person redundant from my team, given me her work load, paid her out £15k redundancy and then gave her a job in the dept next to me. So she's never left! They have also sacked another 2 members of staff from my team, leaving me and another lady to cover 5 people's jobs. Upon several meetings to Complain about the stress of it all nothing was done. As a result I have been signed off work with 'work related stress' I have taken 14 working days off work.

Now, my issue is, is that during my time there is have always been paid a my full basic and commission when I have been signed off previously and had general sick periods. However this time they're withholding my commission for the time I was signed off. I wanted to return to work earlier than 14 days but was denied this as my managers weren't available to do my return to work interview - so I have lost out on pay because of that too.

Now, in my eyes they have set a president as they have always paid me & other employees full pay... and still are to other people, now all of a sudden, and without notification, they aren't.

Is this right?

I'd completely support their decision had it always been that way, however on the basis I was pushed to being off due to be over worked, and not paid a single penny extra for it, I don't see how this is fair!

Do I have a case?

it doesn't sound like there's any rhyme or reason as to why they've particularly targeted you, so you need to check directly with your manager or HR as to why the commission payment has been omitted on this occasion when historically that hasn't been the case for you and other employees signed off sick.

It isn't possible to say that you have a case until you've verified with them, in case it's a clerical error or a change in policy that was poorly communicated.

What dues it say in your contract or sick policy?

I'd contact HR and find out if the policy has changed so you understand why this has happened.
