Resigning just before end of maternity - annual leave?

I am due back from a years mat leave in February and have decided it's not the right thing to do. If I formally resign in a couple of weeks time, which is just within the notice period of one month, I won't have to return at all. I will have accrued about 27 days of annual leave by that point as I went on mat leave just before the start of a new A/L year. Will they make me "use it" before I resign, or will they have to pay me for it? Obviously it would be quite nice to have nearly a months pay... but seems a bit too good to be true, I can see them making me use it to cover my notice period. Does anyone know?

Also I only claimed SMP as I did have a feeling that I wouldn't be returning, so shouldn't have anything to pay back in terms of mat pay.

What do you mean make you 'use it'? Confused

There was a very similar post to this the other day OP, the advice on there still stands. If they use it to cover part of your notice period you'll still be getting paid for the holiday days.
