sickness pay

A florist works for a small business and has never had one day off through sickness. She has now had her first day off because she is unwell, she actually collapsed at work. Should she still receive a day's pay?

It depends on her contract.

Sometimes small business' don't have employee contracts, whereby it will revert to the law & no, she wouldn't be entitled to be paid while she is self-certifying (for the 1st 3 days).

After the "qualifying period" she would be entitled to SSP (with a GP's note) if she earns a minimum of £118 per week.

The never been sick before info is a red herring. Just consider the contract wording. Do you have it?

Depends whether they get contractual sick pay or just Statutory sick pay. SSP isn't paid for the 1st 3 days

I'm assuming that the contract says something like manager's discretion when I say legally no.

First 3 days are usually not paid, no.

Legally, no.

But it depends on the contract. I get full sick pay for upto six months, starting from day one. Other people get nothing except SSP which only kicks in on the fourth day.
