Was I discriminated?

Last week i completed a first round interview.

I was invited back for a second interview and was made aware that there was two others who were invited back also.

During the interview i was asked my marital status and if i had kids. This was a design job so i brought examples of my work.. the interviewer asked could he keep some of my designs and promised these would be returned at the second interview which he promised i would be part of.

I was advised that the second round of interviews would be held this week. After a phone call with the interviewer regarding general information i received an email that i was unsuccessful and ultimately that the only reason was the successful applicant only had to give one weeks notice.. where as i had previously stated i had to give 4 weeks.

Essentially a person who could give less notice than me was the difining reason as to why i was unsuccessful. Despite being informed of a second interview that i would be attending.. no second interviews took place and the interviewer has hold of my drawings.

Please advise

To establish a prima facia case of discrimination, you have to show evidence that the job was awarded to someone who did not display the same protected characteristics as you.

Do you know who was hired?

Assuming you’re a woman, are they male?

Assuming you have children, do you know if they don’t?

No, they hired the person who found start the quickest - that's not a protected characteristic

TheAlternativeTentacle · 14/10/2019 23:23

notice period is not a protected category.

As above - discri.ination must be based on a protected characteristic. If a business need means thet want to employ someone with a shorter notice period they are entitled to do that.

^I would never have given my designs. You need to get it back

Sleepingboy · 14/10/2019 23:49

Just ask for them back

KellyHall · 14/10/2019 23:54

Notice periods - This is standard practice I'm afraid.

Keeping your work - You need to ask for it back, pronto, before they keep it as their own.
