Hello,
My partner was let go from his work today after a month and a half and has been told his work was not up to the standard of the previous employee. He had never been told this before and has had no meetings with anyone about his performance.

Are they allowed to get rid of him without notice? He said they basically called him into the office and said they were letting him go that day. I thought that he would have had to have had at least a weeks notice? They were very vague about the reasons of letting him go and didn’t explain them to him other than ‘clients were unhappy,’ but gave no proof or further information of how.
This same company has also lied to him in his interview saying he could work from home and work in a certain part of the company yet this all changed when he actually started. He wasn’t allowed to work from home which was a big factor in him taking the job as it’s quite far away.
I don’t think there is much that can be done but I’m curious about his rights about notice period and holiday pay etc?

They can let him go, but must pay any notice period in his contract unless he was summarily dismissed for gross misconduct.

Ah ok, so he is owed his wages for the month and his notice period. Thanks! It definitely wasn’t gross misconduct.

It could be wrongful dismissal if they haven't given contractual notice. If he was on a probationary period lots of places have a week's notice, which is the statutory minimum for working over a month.

There are very few employment rights without 2 years service.

He'll be better off elsewhere even if it doesn't seem like it today.

What does his contract say his notice period is?

Is he sure they are not going to pay him his notice? It's probably a week, at this stage in his employment.

He doesn’t know anything about notice period yet. He just left the same day. His contract is in his emails, he will be able to download it when he is on the computer as he is away from home at the moment.
Definitely better off elsewhere, I agree!
