Breaks at work

Hi I have worked for the same company for over 10 years. I am contracted to work 18 hours over 2 set days. My old line manager gave me a 20 minute unpaid break on each shift. I now have a new line manager who is trying to force me to take an hour unpaid break each shift. Taking my weekly hours down to 16. My employee handbook states:

Details of your break periods are contained in your contract of employment. The timings of these breaks are as directed by your line manager.

My contract states:

Lunch Break (unpaid): To be scheduled according to workload

I am truly not happy about this but I do not know where I stand. Any advice would be greatly appreciated.

Taking time unpaid shouldn't affect your contracted hours. So if they are going to implement this then you should be doing 10 hours each day with an hour unpaid so you still get your 18 contracted hours.

20 minutes is the statutory minimum for those working 6 hours or more. 9 hours is a long day. It is normal for breaks to be unpaid. Perhaps workload means it was felt the 40 minutes were not required or that you would be more efficient with a longer break. Is it only you this affects?

Some days I work without a break at all depending on the workload of staff situation it does not bother me. I am contracted to work 12 until 9 on 2 days no where does it say with an hour off in between. It is affecting others with breaks as long as 2 hours being given. To me that would be a split shift not a break.

12 to 9 with 20 minute break is still not 18 hours.

No it’s not your right. So if he wanted to he could make me work 12-3 then have a break for 3 hours then come back in at 6-9 even though I am contracted to work 12-9 I want to know where if stand on him forcing me to have a break for an hour not if my hours add up

If your contract is 18 hours then that is what you should get paid for

Is my post invisible or...?

dementedpixie · 14/09/2019 16:33

Does it state the amount of hours you are contracted to do?

Thank you all for your comment apparently it’s a change in my contract if he does this and I don’t have to agree. I will be speaking with HR and my line manager on Monday and hopefully will resolves this problem
