Maternity Overpayments

I have been overpaid by my company during my maternity leave.. we have agreed on a repayment plan... my question is they are deducting the net amount paid to me through net pay deductions... I am unsure of what to do about the tax that I have paid on those over payments last year? would appreciate advice on this.

Hello, I'm not 100% sure but it would probably be best to contact HMRC and talk to them about tax you've paid

HMRC would advise - could be that they will change your tax code next year when they get the P60 end-of-year note but it is probably worth speaking to them for your own peace of mind.

I'm hoping you get some good advice because I'm in the same situation.

Hi, I work in public sector HR and Payroll. If they are deducting the net amount then the people in your company’s HR/Payroll team will have taken into account the tax/NI/pension you paid on the money, particularly if the overpayment was from a previous tax year.

I would recommend speaking to your HR department and asking them how the deductions that have been set up have been calculated. They should be able to explain the process and then, if you still need to, you could call HMRC.

If you call HMRC first, they likely will not know anything about your overpayment (as this is an issue between you and the company you work for) and therefore would not be able to give accurate advice for your particular situation.

Thank you for replying
They have given me a breakdown of how much I actually received in my bank account which was post tax. They are recovering this amount. Unfortunately My HR are not helpful... I have questioned them about this but not got an answer. It just seems common sense to me that why should I have paid tax when i didnt get the benefit of the earnings. So basically if my pay was 100£ and they paid £80 to my account and £20 tax, they are recovering £80 from my taxed income each month.
I tried to talk to hmrc but they said i need to talk to my employer.. maybe i should try again? Its just so very frustrating!
